The purpose of this section is to protect the public health, safety
and welfare of the Borough of Mountain Lakes inhabitants by establishing regulations
for the conduct of persons in the Borough of Mountain Lakes on Halloween and
to provide enforcement and penalties for violators hereof pursuant to N.J.S.A.
40:48-2.52 and otherwise pursuant to law.
In addition to the definitions provided N.J.S.A. 40:48-2.52, as used
in this section, the following terms shall have the meanings indicated:
October 30 and 31 of each year or any other date or dates upon which
Halloween is customarily celebrated or observed and which may be designated
or recognized by the Council by resolution for the undertaking of activities
and celebration of Halloween. In the event a date or dates other than October
30 and 31 shall be designated or recognized by the Council by resolution,
notice of an adoption of such resolution shall be published by the Borough
Clerk in an official newspaper of the Borough no later than 10 days prior
to the date or dates designated or recognized.
It shall be unlawful for any person of any age to possess eggs upon
any of the streets, highways, alleys, public parks or other public places
in the Borough of Mountain Lakes on Halloween for any purpose other than human
consumption.
It shall be unlawful for any person under the age of 18 years to appear
on the streets, highways, alleys, public parks, public homes or public places
in the Borough of Mountain Lakes on Halloween between the hours of 10:00 p.m.
and 6:00 a.m. This section shall not apply to a person under the age of 18
years:
A.
When engaged in an errand involving a medical emergency.
B.
When in attendance at evening classes or at an extracurricular
school activity or an activity sponsored by a religious or community-based
organization or cultural, educational or social event.
C.
When lawfully employed.
D.
When accompanied by a parent or guardian or other adult
having the care and custody of the person.
E.
When upon an emergency errand or legitimate business
directed by the juvenile's parent or guardian.
Any person who shall violate any provision of this section shall be subject to the penalties as provided in this Code at § 1-17, Violations and penalties, but in no event in excess of $1,000 and shall perform community service of no less than 25 hours.
