A. 
Permit. No driveway, private road or curb opening shall be constructed or reconstructed within a Borough right-of-way or connecting to a municipal road without obtaining a permit from the Director of Public Works or the Borough Engineer. The permit shall specify the location of the proposed work, and the applicant shall provide sketches or information as may be required by the Director of Public Works or Borough Engineer to facilitate his issuance of the permit. A separate permit shall be required for each driveway, private road or curb opening, except that only one permit shall be required for a driveway and curb opening of common function.
B. 
Fee. The fee for such a permit shall be as set forth in § 111-3C of this Code.
C. 
Bond. The applicant shall post bond(s) of such amount as recommended by the Director of Public Works or the Borough Engineer to insure the satisfactory completion of the proposed work.
A. 
Standards. Curb openings, both in new curbs and in existing curbs, shall be constructed in accordance with the applicable portions of the Standard Details for Subdivision Construction, latest revision, as prepared by the Borough Engineer. For openings in existing curbing, the entire depth of the existing curbing shall be removed for such length as hereinafter defined. Creating a lowered curb section by breaking down a portion of the existing curb or applying asphalt over the existing curb is prohibited.
B. 
Width; protection of curbing and pavement. The minimum width of all curb openings shall be as shown on the Standard Details for Subdivision Construction; however, the Director of Public Works or the Borough Engineer shall have the authority to require greater widths when, in his judgment, it is necessary for the public safety and welfare. The permittee shall remove only as much existing curb as required to construct the opening. However, in the case of concrete curb, the permittee shall remove full sections of the curb to the nearest expansion joint on each side of the proposed opening. All removed curb and any curb damaged during the work shall be replaced by the permittee. Any pavement or any other surface or structure which is damaged by the permittee during the work shall be replaced by him, to the satisfaction of the Director of Public Works and the Borough Engineer.
C. 
Finishing surface. All forms for concrete are to be checked and approved by the Director of Public Works or the Borough Engineer prior to the pouring of concrete. The concrete shall be thoroughly spaded, tamped, or vibrated to ensure that the forms are completely filled and free from voids. All unformed concrete surfaces shall be finished to a smooth dense surface before initial set of the concrete. Upon removal of the forms, all exposed surfaces shall be rubbed and finished to eliminate any voids or irregularities.
D. 
Expansion joints. A half-inch premolded expansion joint shall be placed at intervals of 10 feet. Whenever the curb abuts existing curb, a half-inch premolded expansion joint shall be placed between the new and old construction. The joint material shall be a true cross section of the curb and shall extend through the mass of concrete, from top to bottom and from side to side.
E. 
Construction barriers; warnings. It shall be the duty of the permittee to properly guard curb, road and driveway construction by erecting suitable barriers, warning signs and flares. The permittee shall be liable for any neglect to safeguard the traveling public.
A. 
All new and reconstructed driveways shall be paved within the Borough right-of-way and shall conform to the applicable portions of the Standards for Subdivision Construction, latest revision, as prepared by the Borough Engineer. The driveway shall adjoin the municipal road and shall be a continuous paved surface from its point of connection with the municipal road to the right-of-way line. That portion of the driveway which is within the Borough right-of-way shall be termed the "driveway apron," shall have a minimum width of 12 feet and shall be paved with three inches of bituminous asphalt material.
B. 
Driveways shall intersect municipal roads as near to 90º as possible, and in no case shall be less than 60º.
C. 
Grades of driveway aprons shall not exceed 8%, and grades of the driveways outside the Borough right-of-way shall not exceed 15%.
D. 
All driveways shall be constructed or resurfaced at the connection with a municipal road so as to prevent water from draining into the driveway or across the municipal road.
Private roads shall conform to the standards for municipal roads, as delineated in Chapter 208, Subdivision of Land and Site Plan Review, of this Code.
No certificate of occupancy shall be issued for new homes or buildings where driveways, curb openings, or private roads are involved until the driveways, curb openings or private roads have been completed, inspected and approved by the Director of Public Works or the Borough Engineer and so certified to the construction official.
Any person violating this article shall be subject, upon conviction, to a fine of not more than $200 or imprisonment for not more than 90 days, or both, at the discretion of the judge.
