A code regulating retail food establishments and fixing penalties is
hereby established. A copy of the code is annexed to this chapter and made
a part of it without the inclusion of the text.
The code established and adopted by this chapter is described and commonly
known as "Chapter 12 of the State Sanitary Code."
Three copies of Chapter 12 of the State Sanitary Code have been placed
on file in the office of the Borough Clerk for the use and examination of
the public.
A.
License required.
(1)
No person shall operate a retail food-handling establishment
unless a license, or approval of an existing license to operate same, shall
have been issued by the Board of Health. Such license, or approval of an existing
license, shall be posted in a conspicuous place in the establishment.
(2)
A person conducting an itinerant retail food-handling establishment shall secure a license in accordance with § 279-2, or if such person is the holder of a certificate, permit or license issued by the Board of Health of another jurisdiction, the certificate, permit or license may be approved by this Board of Health.
B.
Issuance of license; fees.
(1)
Licenses issued or approved under the provisions of this chapter shall be issued according to and subject to the provisions of § 279-2 of this Code. Applications for renewal thereof shall be submitted, together with the required fee, prior to January 15 of each year.
(2)
Fees for a license or approval of an existing license
shall be as set forth in § 111-3I.
Each food establishment shall be required to send a representative who
is in a food-handling supervisory capacity to an annual seminar conducted
by the Board of Health, which seminar shall deal with, among other things,
instruction and training in the latest sanitary and health regulations.
