No person, firm, corporation or other entity shall install, maintain or operate an emergency rapid entry system without first having obtained a permit from the Fire Department of the Borough of Upper Saddle River and/or other department or official as may be designated by the Mayor and Council.
Application for a permit to install an emergency rapid entry system shall be made, in writing, to the designated official and upon such form as shall be provided, and shall contain the name and address of the applicant, the proposed specific location of the key vault and shall be signed by the applicant. In addition, as part of the application process, the applicant shall execute an agreement which shall provide that if such permit is issued, the applicant agrees to indemnify, defend and hold harmless the Borough of Upper Saddle River, its officials, agents, servants and employees from any and all suits, actions or claims of any nature whatsoever, relating to the installation, maintenance, operation and use of the emergency rapid entry system, including entry of the premises wherein such system is maintained.
A. 
Every emergency rapid entry system for which a permit is applied for shall be required to be approved by the officials enumerated in § 48-1 of this chapter.
B. 
The system for which application for approval is made shall be required to be compatible with the master key for vault entry maintained by the Upper Saddle River Fire Department.
C. 
The key box or vault shall be installed in a location to be approved by the Borough, which location shall be at least six feet above ground level.
D. 
The officials designated with the responsibility of administering this chapter may, from time to time, prescribe rules for the installation, operation and use of an emergency rapid entry system, subject to the approval of the Mayor and Council.
For violation of any provision of this chapter, the maximum fine shall be in accordance with § 1-15 of this Code. Each day that a violation shall continue shall constitute a separate offense.
