[Adopted 1-8-2002 by L.L. No. 1-2002]
This article shall be known and may be cited as "Local Law No. 1 of
the Year 2002, Changing the Terms of Office of the Members of the Town of
Clarkson Planning Board."
[Amended 12-12-2006 by L.L. No. 4-2006]
The Town Board of the Town of Clarkson, through the power granted to
it under the appropriate provisions of the Town Law, has created a Planning
Board and has appointed members to said Board. The Planning Board consists
of five members. The Planning Board has been given certain powers such as
site plan review, adding or changing the Official Map of the Town, approval
of plats, granting of special permits in specific instances and changes in
the zoning conditions as part of plat approval. In order to provide the people
of the Town of Clarkson a more frequent opportunity to serve on such an important
Board in the Town of Clarkson, which Board affects the lives and property
of many residents, the Town Board has determined to exercise the authority
given to it under the laws of the State of New York to amend the Town Law
to reduce the duration of the terms during which a Planning Board member holds
office. It is the intent of this article to supersede the provisions of § 271,
Subdivisions 4 and 5, of the New York State Town Law.
As used in this article, the following terms shall have the meanings
indicated:
MEMBER OF THE PLANNING BOARD
A person appointed to the Planning Board of the Town of Clarkson
by the Town Board of the Town of Clarkson, pursuant to the authority granted
the Town Board under § 271 of the Town Law.
TERM OF OFFICE
The period of time a member of the Planning Board appointed by the
Town Board shall hold office.
Any person appointed as a member of the Planning Board by the Town Board
of the Town of Clarkson after the effective date of this article shall serve
for a term ending on the third December 31 from the date of appointment. If
a vacancy shall occur other than by expiration of term, it shall be filled
by the Town Board by appointment for the unexpired term.
The current term of any person heretofore appointed to the Planning
Board shall not be changed by this article, but if such person ceases to serve
on said Board the replacement term shall be as provided herein. Upon expiration
of the current term of any person heretofore appointed, such new term for
such person or another person appointed shall be as provided herein.
