A. There shall be a Village Planning Board appointed
by the Mayor, subject to the approval of the Board of Trustees, which
Planning Board shall consist of five members. The terms of appointment
shall be made pursuant to law. If a vacancy occurs other than by expiration
of term, it shall be filled by appointment, pursuant to law. Any member
may be removed by the Mayor for cause after a public hearing.
B. The office of Secretary to the Planning Board is herewith
created. Appointment to the position of Secretary of the Planning
Board shall be made by the Planning Board for a term of one official
year. If a vacancy occurs, other than by expiration of term, it shall
be filled by appointment pursuant to law. The appointee may be removed
for cause after a public hearing.

C. There shall be two alternate members of the Planning
Board appointed by the Mayor, subject to the approval of the Board
of Trustees, for a term of four years each. The Chairperson of the
Planning Board may designate an alternate member to substitute for
a member due to a conflict of interest or where a member cannot participate
for other reasons. Alternates so selected shall be on a rotating basis
and once designated shall possess all the powers and responsibilities
of a member for the application(s) for which the designation has been
made.

D. Training.

(1) Each member of the Planning Board shall complete,
at a minimum, four hours of training each year designed to enable
such members to more effectively carry out their duties. Training
received by a member in excess of the four hours in any one year may
be carried over by the member into succeeding years in order to meet
the requirements of this subsection. Such training shall be approved
by the Village Attorney and may include, but not be limited to, training
provided by a municipality, regional or county planning office or
commission, county planning federation, state agency, statewide municipal
association, college or other similar entity. Training may be provided
in a variety of formats, including but not limited to electronic media,
video, distance learning and traditional classroom learning.
(2) To be eligible for reappointment to such Board, such
member shall have completed the training promoted by the Village pursuant
to this subsection.
(3) The training required by this subsection may be waived
or modified by resolution of the Board of Trustees when, in the judgment
of the Board of Trustees, it is in the best interest of the Village
to do so.
(4) No decision or action of the Planning Board shall
be voided or declared invalid because of a failure to comply with
this subsection.

Such members shall receive no payment for their
services as members of the Board.

The Chairman of the Board shall be designated
Mayor, with the approval of the Board of Trustees or, on failure to
do so, shall be elected from and by its own members.

A. Office of Planning.
(1) Establishment. There is hereby created, as a separate
department in the Village government of the Village of Northport,
the Office of Planning, being and intended to be the successor office
to the Office of Planning Coordinator.
(2) Department head. The duly appointed Village Administrator
shall be head of the Office of Planning, and he shall be vested with
the authority, direction and control of such Department and shall
bear the additional title of Planning Coordinator respecting the performance
of duties hereinafter set forth and any other duties, authority or
responsibility granted to the position of Planning Coordinator by
any of the chapters of the Code of the Village of Northport.

(3) Appointment of Director; removal; classification.
The title and position of Planning Coordinator shall be held by the
person appointed to the position of Village Administrator.

(4) Powers and duties generally. The Planning Office shall
have cognizance, jurisdiction, supervision and control over and the
Planning Coordinator shall be charged with the responsibility of the
following, subject to the supervision of the Planning Board of the
Incorporated Village of Northport and Board of Trustees:
(a)
The implementation, enforcement and application of Chapter
A312, Subdivision Regulations, Articles
I and
II, the residential and business subdivision regulations of the Planning Board of the Village of Northport.
(b)
The implementation, enforcement and application of Chapter
247, Site Plan, Article
I, Business Zones.
(c)
The provision of technical advice and assistance
to the Planning Board of the Village of Northport in all residential
and business subdivision applications and site plan applications.
(d)
The implementation, enforcement and application of Chapter
138, Environmental Quality Review, of the Code of the Village of Northport.
(e)
When assigned, the design of public works undertaken
by the Village of Northport.
(f)
The supervision of all public works contracts
entered into by the Village of Northport, including preparation of
all specifications for such contracts.
(g)
The preparation of specifications for all contracts
let by the Village of Northport.
(h)
Assistance to the Department of Building, Housing
and Code Enforcement in the administration of the duties of said Department
when necessary.
(i)
Acting as the Village of Northport's representative
in liaison with other branches of government regarding public works,
planning matters and environmental matters.
(j)
Acting as the liaison between the Village of
Northport, including both the Planning Board and Board of Trustees,
and any professional engineer employed by the Village of Northport
to provide engineering services in a particular matter.
(k)
Performing such other duties as may be assigned
by the Board of Trustees from time to time.
(5) Village Engineer. Whenever, in any other ordinance,
resolution, local law or rule and/or regulation of the incorporated
Village of Northport or the Planning Board of the Incorporated Village
of Northport, the words "Village Engineer" appear, said term "Village
Engineer" shall be deemed to mean "Planning Coordinator," so that
the terms are to be considered synonymous, unless otherwise specifically
directed by resolution of the Board of Trustees of the Incorporated
Village of Northport. In such latter event, the professional engineer
and/or other expert employed by the Village Board of Trustees for
the particular matter shall be deemed for all purposes to be the Village
Engineer, subject to the provisions of the aforesaid resolution of
the Board of Trustees.
(6) Availability for public inspection. The Planning Coordinator
shall keep careful and comprehensive records of applications, permits
issued, certificates issued, inspections made, reports rendered, maps,
plats and plans filed and notices or orders issued. These records
shall be open to public inspection, for good and sufficient reasons,
at reasonable hours, but shall not be removed from the office of the
Village Clerk. The Planning Coordinator shall retain on file copies
of all papers in connection with his/her work as may be required by
law.
B. Services of assistants and experts. The Planning Board
of the Incorporated Village of Northport shall have the power and
authority to employ experts and a staff and to pay for their services
and such other expenses as may be necessary and proper, not exceeding,
in all, the appropriation that may be made for such Board by the Board
of Trustees of the Incorporated Village of Northport. Such experts
and staff shall include but shall not be limited to the services of
the professional engineer when the same are deemed necessary.
