Section 209-m of the General Municipal Law authorizes the chief executive officer of a municipality to grant or request police assistance in the form of forces, equipment or supplies to or from other local governments. The local government receiving the aid assumes the liability for all damages arising out of the extension of the aid and must reimburse the assisting local government for salaries, loss of equipment or other expenses incurred by the assisting police force. The purpose of this Article is solely to authorize the Chief of Police, since he is the individual with the best knowledge of whether the Town police will require additional services in case of a civil disturbance or whether the Department is capable of supplying services to another local government, to be the person in the first instance to make the decision regarding whether to request or provide assistance, rather than the chief executive officer.
The Town of Southampton hereby delegates to the Chief of Police of the Southampton Town Police Department the powers under New York State General Municipal Law § 209-m to grant or request police assistance to or from other local governments.
