As used in this article, the following words shall have the meanings indicated:
TRAIL PRESERVATION AGREEMENT
A written agreement, between the Town of Southampton and the owner of eligible property traversed by a trail, by which the property owner agrees to preserve that portion of the property upon which the trail exists as a trail, and not to eliminate, build on or block access to the trail, for a period of one year.
Eligible property must have at least one unobstructed existing trail located on it, which the property owner will permit hikers and equestrians to traverse.
A. 
Any owner or owners of eligible property may obtain from the Town Clerk an application for a trail preservation agreement in such form as shall be approved by the Town Board, which shall contain a representation by the property owner that hikers and equestrians will be permitted to traverse the trail and that the property owner will not eliminate, build on or block access to the trail for a period of one year. The property owner shall complete the form and submit it to the Town Clerk. The Town Clerk shall forward the application forthwith to the Assessor and to the Town of Southampton Trails Advisory Committee for their recommendations.
B. 
The Town Board shall hold a public hearing on any eligible application upon 10 days' notice to the public of the time and place of such hearing. Following the public hearing, the Town Board shall determine whether acceptance of the agreement will maintain or enhance the conservation of a natural or scenic resource that will benefit the public welfare. The Board may approve, disapprove or approve with modifications the proposed trail preservation agreement.
C. 
The fully executed trail preservation agreement shall be filed with the Town Clerk on or before the appropriate taxable status date.
