[HISTORY: Adopted by Mayor and Borough Council of the Borough of Rocky Hill 2-4-1991 by Ord. No. 1-91. Amendments noted where applicable.]
Pursuant to N.J.S.A. 40:55D-25c, the Zoning Board of Adjustment of the Borough of Rocky Hill is hereby abolished as a separate entity, and all powers, duties and functions of said Board are hereby vested from this time forward in the Planning Board of the Borough of Rocky Hill.
Notwithstanding the foregoing, the Zoning Board of Adjustment of the Borough of Rocky Hill shall continue in existence for the purpose of resolving all pending applications and other matters now before it and shall retain jurisdiction over such pending matters until they are resolved. Once all currently pending matters and applications are resolved, the Zoning Board of Adjustment shall, as provided above, be dissolved.
Pursuant to N.J.S.A. 40:55D-25c no Class I members (Mayor) or Class III members (Council representative to the Planning Board) shall participate in the consideration of applications for development which involve relief pursuant to NJ.S.A. 40:55D-70.
In the event that the population of the Borough of Rocky Hill ever exceeds 2,500, the Mayor and Borough Council shall, as required by N.J.S.A. 40:55D-25, reestablish the Zoning Board of Adjustment of the Borough of Rocky Hill.
