There is hereby created a Board of Review consisting of five members, one appointed for a term of one year, one appointed for a term of two years, one appointed for a term of three years, one appointed for a term of four years and one appointed for a term of five years. At the expiration of such terms, the terms of office of their successors shall be five years. All appointments to fill vacancies shall be for the unexpired term. No member shall be on any other board or commission in the City or need be a resident of the City. The Board shall choose its own Chairman, and the Superintendent or his duly authorized representative shall act as secretary but shall not vote on any issues presented to agenda for each meeting, which shall briefly explain the nature of each matter to be considered by the Board, and he shall send a copy of said agenda to each member of the Board.
The Board shall meet upon call by the Chairman.
One member of the Board should be a registered professional engineer; one member should be a practicing sanitary engineer; one member shall be a representative of industry or manufacturing enterprise; one member shall be a lawyer; and one member shall be selected at large for his interest in accomplishing the objectives of this chapter. Appointments shall be made by the Mayor with the approval of the Council.
The Board of Review shall hear and determine appeals from any person presented with a notice of violation in accordance with the provisions of this chapter. Any person requesting an appeal must notify the Superintendent of his desire to appeal prior to the expiration of the time limit for compliance stated in the notice of violations.
It shall be the function of the Board to vary or modify the application of any of the provisions of this chapter when strict enforcement would result in practical difficulties or unnecessary hardship.
Each member shall take the appropriate oath of office and shall be paid the sum of $10 for each meeting attended.
