The Board of Directors shall, from time to time,
adopt such regulations as it deems fitting, necessary or proper to
control the issuance of permits for street work and the work to be
done under said permit. These regulations may be amended from time
to time by the Board of Directors upon recommendation of the Director
of Public Works.
The Director of Public Works, with the express approval of the Town Planning and Zoning Commission, shall compile, and amend, a manual listing of all types of work to be performed in, on, over or under any of the streets or highways in the Town by anyone other than the Town for which a permit is required by the ordinances of the Town or the statutes of the state. This manual shall include the regulations required by §
279-1 and shall be filed with the Town Clerk.
Streets and sidewalks obstructed by excavations
or building material must be guarded by barriers during the day and
by both barriers and colored lights by night.
It shall be unlawful and a nuisance to move
any building through any street or highway of the Town or to permit
any building in process of moving to remain in any such street or
highway without a license from the Superintendent of Highways.
It shall be unlawful and a nuisance to place
or continue the deposit of any building materials on any street or
highway of the Town without a license from the Superintendent of Highways.
The opening or continuing of a drain or conductor
pipe in such a manner that the same is discharged upon the surface
of any street, highway, sidewalk, curb or property of the Town shall
be unlawful and a nuisance.
It shall be unlawful and a nuisance to resist,
molest, disobey or interfere with the Superintendent of Highways,
or any officer of the Town, while engaged in the duty of keeping the
streets or highways of the Town free from obstruction and convenient
for public use.
The placing, dropping or throwing upon the streets
and highways of any materials or substances which obstruct or impede
the use of such streets and highways or which render the use of such
streets and highways hazardous or which render such streets and highways
unsightly shall be unlawful and a nuisance.
In maintaining awnings projecting over any sidewalk
in the Town there shall be a minimum clearance of seven feet from
the sidewalk to the lowest part of the framework or any fixed portion
of any retractable awning, except that the bottom of the valance of
canvas awnings may extend to six feet nine inches above the sidewalk.
Retractable awnings shall be securely fastened to the building and
shall not extend closer than 12 inches from the curbline. They shall
be equipped with a mechanism or device for raising and holding the
awning in a retracted or closed position against the face of the building.
Violation of this section shall constitute a violation of this Code
and shall be a nuisance.
No person shall drive, guide or have the care
of two or more horses harnessed respectively to different vehicles;
and no person shall lead or drive any horse upon any sidewalk or footpath
except whenever necessary to cross the same.
Any person who shall commit, aid, advise, abet or encourage the committing of any of the acts of nuisance enumerated in §
279-7,
279-8,
279-9,
279-10 or
279-11 shall be fined not less than $10 nor more than $100 in addition to the costs of abating such nuisance or eliminating the effect thereof. Such costs, if not paid within 30 days of the written notification of the amount due, shall bear interest from the date of such abatement or elimination at the same rate of interest as is provided by law for interest on delinquent taxes. The continuance of any encroachment or obstruction upon any street or highway, or the continuance of any of the enumerated acts of nuisance which is of a continuing nature for a day of 24 hours after the day of commencement thereof shall be deemed a separate and single offense.
