Whenever lands or any interest in lands is required by the County Council
for the establishment, enlargement or improvement of any public facility or
purpose to be created, maintained or administered by the county and the County
Council shall for any cause be unable to contract with the owner or owners
thereof upon what they deem to be a fair valuation thereof, the County Council
may, in the exercise of the power of eminent domain, institute condemnation
proceedings.
The provisions of Chapter 61 of Title 10 of the Delaware Code shall
govern the procedure for all condemnation.
