Except as otherwise provided by this chapter, any person, firm or corporation violating any of the provisions of this chapter is guilty of a misdemeanor and, upon conviction, shall be subject to the general penalty provisions of Chapter 1, Article IV, General Penalty.

Any person, firm or corporation violating any one of the following enumerated sections of this chapter is guilty of a misdemeanor and, upon conviction thereof, shall be subject to a fine not to exceed $750, to which may be added imprisonment not exceeding six months, or both:
Section 328-2, Aiding escape of prisoners.
Section 328-3, Introducing contraband to jail.
Section 328-5, Interfering with law enforcement officer.
Section 328-6, Failure to assist law enforcement officer.
Section 328-9, False alarm of fire.
Section 328-13, Public intoxication.
Section 328-20, Breach of peace; penalty.
Section 328-24, Shoplifting.
Section 328-25, Theft.
Section 328-26, Theft of services.
Section 328-27, Interfering with vehicles.
Section 328-28, Malicious mischief.
Section 328-32, Contributing to delinquency; penalty.

Any person who is convicted of a crime wherein any other person, firm, corporation or public entity has suffered damages or loss to which a monetary value can be ascertained may be required to make restitution to the victim of the crime in an amount not to exceed twice the value of actual loss or damages as a condition of his or her deferment, suspension or probation of sentence, and no sentence imposed as a result of the conviction may be deferred, suspended or probated unless the court has first considered the desirability of requiring restitution as a condition thereof.
