Board of Health legislation — See Part III of this Code.
There shall be in and for this borough a Board of Health in accordance
with An Act to Establish in This State a Board of Health and a Bureau of Vital
Statistics and to Define Their Respective Powers and Duties, approved March
31, 1887, and the several supplements thereto.[1]

The Board of Health shall consist of five members, and of the first
appointees, two shall serve for terms of one year, and one shall serve for
a term of two years, one shall serve for a term of three years and one shall
serve for a term of four years, and after the first appointments, all appointments
shall be for terms of four years, except that in the case of vacancies, the
appointments shall be for the unexpired term.
A.
The members constituting the Board of Health shall be
citizens of the borough appointed by the Mayor with the advice and consent
of the Council. One of the members may, in the discretion of the Council,
be a licensed physician of the State of New Jersey who shall be a citizen
of the borough. Nothing contained herein shall prohibit one member of the
Council from being appointed to the Board.
B.
If any vacancies occur among the members of the Board
of Health, they shall be filled in the same manner as an original appointment
but only for the unexpired portion of the term.
C.
All members of the Board of Health shall serve without
compensation, except that members of the Board shall be reimbursed by the
borough $5 per meeting, paid quarterly, for expenses incurred while performing
their duty as a member of the Board.
A.
The Board of Health may adopt rules, regulations or ordinances
for its government and that of its officers and employees not inconsistent
with law or the State Sanitary Code and shall have power to pass, alter or
amend ordinances and make rules and regulations in regard to the public health
within its jurisdiction for the purposes as enumerated in N.J.S.A. 26:3-31.
B.
The Board of Health shall elect from any of its members
a President, Vice President and Secretary.
A.
The Board of Health shall not contract any debt of any
kind beyond the amount of the appropriations made for its use each year by
the Borough Council of Andover.
B.
The Board of Health shall annually submit
to the Council a report on the services of the Board, recommendations for
the following year's budget, reviews on its employees, appointees and
any salary requests, no later than December 15. Said annual report shall be
used by the Council in its approval process for the ensuing year's health
budget.
