This chapter is enacted pursuant to the authority granted to municipalities under Article 9-A of the General Municipal Law of the State of New York and shall be known as the "Games of Chance Law of the Town of Barton."
A. 
The words and terms as used in this chapter shall have the same meanings as such words and terms used in Article 9-A of the General Municipal Law of the State of New York, unless otherwise provided herein or the context requires a different meaning.
B. 
As used in this chapter, the following terms shall have the meanings indicated.
GAMES OF CHANCE
A game of chance as now or hereafter defined in § 186, Subdivisions 3, 3-a and 3-b of the General Municipal Law of the State of New York, and shall include merchandise wheels, bell jars and raffles.
TOWN
The Town of Barton.
OFFICER
The Enforcement Officer of the Town of Barton.
Games of chance may be conducted by an authorized organization, upon obtaining a license from the Town Clerk as provided in Article 9-A of the General Municipal Law and as provided in this chapter. Such games of chance shall be conducted in accordance with the laws of the State of New York, the rules and regulations adopted by the New York State Racing and Wagering Board and pursuant to the provisions of this chapter.
The conduct of games of chance shall be subject to the restrictions imposed by Article 9-A, § 189, of the General Municipal Law and the rules and regulations adopted by the New York State Racing and Wagering Board.
Games of chance may be conducted on Sundays pursuant to this chapter, with the exception that no games may be conducted on Easter Sunday, Christmas Day or New Year's Eve.
The Enforcement Officer of the Town of Barton shall exercise control over and supervision of all games of chance.
This chapter shall take effect 20 days following the approval of such chapter by a majority of the qualified voters of the Town of Barton voting on this proposition therefor, at the general election held in the Town of Barton, New York, pursuant to the provisions of the Town Law of the state. [1]
