There is hereby established in the City of Batavia
a scale of rents to be called "sewer rents," the revenues from which
shall be used for the payment of the cost of the management, maintenance,
operation and repair of the wastewater treatment system, including
wastewater treatment works, and, in the event of any surplus thereafter,
may also be used for the enlargement or replacement of the same, and
for the payment of the interest on any debt incurred for the construction
of such sanitary sewer system, including wastewater pumping, wastewater
treatment works, and for retiring such debt, but shall not be used
for the extension of a sewer system to serve unsewered areas, or for
any purpose other than one or more of those herein specified.

In addition to any and all other fees and charges
provided by law, the owner of any parcel of real property connected
with the wastewater treatment system of the City of Batavia, including
but not limited to real property connected with said wastewater treatment
system by means of a private sewer or drain emptying into such wastewater
treatment system, shall pay a sewer rent for the use of such wastewater
treatment system. Such sewer rent shall become due and payable quarterly,
and be based on the metered consumption of water or as otherwise provided
in this article.
A. City customers: all volume - $3.14/1,000 gallons of
water usage.
B. Town customers served directly by the City: all volumes
- $4.17/1,000 gallons of water usage.
C. Town sewer districts.
(1) Master meter bulk rate: the bulk rate is $2.81/1,000
gallons.

(3) All sewer charges assume a reasonable allowance for
losses of metered water measured due to evaporation, car washing,
lawn sprinkling, swimming pools, etc.
(4) An allowance for water which is used in such a manner
that it does not subsequently enter the sewer system will be deducted
from the sewer bills only if it is measured by a separate water service
connection and meter. This requires a certification by a professional
engineer that this meter measures only water which is packaged as
previously described and that no interconnection exist. As an alternative
to requiring such metering for swimming pools, a minimum quantity
of 10,000 gallons is required and an inspection fee as set from time
to time by resolution of the City Council shall be charged for inspecting
the installation.
E. These rates shall become effective on April 1, 2008,
as billed on and after July 1, 2008.
In the event that the owner of a lot, parcel
of land, building or other premises discharging wastewater, water
or other liquids into a sanitary sewer, either directly or indirectly,
uses metered City water and water other than metered City water, or
uses water other than metered City water exclusively, the Bureau of
Water and Sewerage shall determine a method of measuring the wastewater,
water or other liquids entering the sanitary sewer. In such cases,
the sewer rental shall be based on this determination.
All expenses in connection with metering shall
be charged to the owner of the land.
All the provisions of this article shall also apply to Article
IX of this chapter unless otherwise specifically provided in Article
IX.
