This chapter shall be known as the "Township of Birmingham Plumbing Code."

The Board of Supervisors of Birmingham Township hereby adopts the International Plumbing Code, 2018 Edition, as now and as hereafter supplemented, reissued, amended and revised, as published by the International Code Council, Inc. Not fewer than three copies of the International Plumbing Code, 2018 Edition, are filed in the office of the Secretary of Birmingham Township, and the same is hereby adopted and incorporated as fully as if set out at length herein.

The following amendments, additions, deletions and changes are hereby made to the International Plumbing Code, 2018 Edition:
A. 
Section 101.1 shall be amended by the deletion of the words "[NAME OF JURISDICTION]" and the replacement thereof with the words, "Birmingham Township."
B. 
The heading of Section 103 shall be deleted in its entirety and replaced with the following:
"SECTION 103 ENFORCEMENT."
C. 
Section 103.1 shall be deleted in its entirety and replaced with the following:
"103.1 General. The Board of Supervisors shall, by resolution, appoint a Building Code Official who shall be certified by the Commonwealth of Pennsylvania under the Act. The Building Code Official shall be responsible for administration and enforcement of this code. The Building Code Official shall be referred to in this Code as the 'Code Official.'"
D. 
Section 103.2 shall be deleted in its entirety and reserved.
E. 
Section 106.6.2 shall be deleted in its entirety and replaced with the following:
“106.6.2 Fee schedule. The permit fees for all plumbing work provided for in this code shall be paid in advance in accordance with the fee schedule established by resolution, duly adopted by the Board of Supervisors of Birmingham Township, as the same may from time to time be amended."
F. 
Section 106.6.3 shall be deleted in its entirety.
G. 
Section 108.4 is deleted and replaced with the following:
"108.4 Violation penalties. Any person who shall violate a provision of the Plumbing Code or shall fail to comply with any of the requirements thereof or who shall install, alter, or repair a plumbing system in whole or in part in violation of this code shall, upon being found liable therefor in a civil enforcement proceeding commenced by the Township, pay a fine of not more than $1,000, plus all court costs, including reasonable attorneys' fees incurred by the Township. If the defendant neither pays nor timely appeals the judgment, the Township may enforce the judgment pursuant to the applicable rules of civil procedure. Imposition of one fine for any violation or noncompliance shall not excuse the violation or noncompliance nor permit it to continue or be repeated, and all such persons shall be required to correct or remedy such violations or defects forthwith. Each section of the chapter violated shall constitute a separate offense, and each day or portion thereof in which a violation of this chapter is found to exist shall constitute a separate offense, each of which violations shall be subject to the imposition of a separate fine imposed by the Magisterial District Judge of not more than $1,000, plus all court costs, including reasonable attorneys' fees incurred by the Township, collectable as specified in this section."
H. 
Section 108.5 shall be amended by inserting "not less than $100" in the first blank and "nor more than $1,000" in the second blank.
I. 
Section 305.6.1 shall be amended by inserting "36 inches" in both blank spaces.
J. 
Section 904.1 shall be amended by the insertion of "24 inches" in the "[NUMBER]" blank.
A. 
No person shall hereafter engage in the business of plumbing and/or house and building drainage in Birmingham Township without first applying for and obtaining a permit to do so pursuant to the provisions of this chapter.
B. 
Application for such permit shall be made on suitable forms provided by the Township and shall be made directly to the Township Plumbing Inspector or such other official as designated by the Board of Supervisors.
C. 
Any person making any false statements to secure a permit or who makes any false answers to any of the questions set forth in the application form shall forthwith forfeit and surrender any such permit thereafter issued.
D. 
Prior to the issuance of any permit, the Plumbing Inspector or designee, unless a property owner is performing plumbing work as defined herein on one's own property, shall require the applicant to submit satisfactory proof that the applicant is a bona fide master plumber or equivalent as defined by the standards in the trade within the area of Birmingham Township. The Plumbing Inspector shall, among other things, require the applicant to demonstrate training, education, experience and provision for continuing training and updating and other qualifications acceptable in the trade.
E. 
The applicant shall furnish to the Plumbing Inspector or designee a certificate of insurance executed by an authorized representative of the agency's insurance underwriter, providing evidence of insurance coverage of the applicant and his employees, if any, for the following:
(1) 
Workmen's compensation and occupation and disease insurance with statutory limits and employer's liability coverage with a minimum limitation of $100,000.
(2) 
Plumbers' or builders' public liability insurance under comprehensive form with bodily injury limits of not less than $100,000 per occurrence.
F. 
Each such application shall be accompanied by the current fee prescribed by resolution of the Board of Supervisors, Page 7 the provisions of which resolution, as the same may be from time to time amended and revised, are incorporated herein by reference.[1]

G. 
Any person aggrieved by action of the Plumbing Inspector or designee in refusing to issue a plumber's permit shall have the right of appeal as provided in Section P-121.
A. 
No person other than a master plumber or a journeyman in such master plumber's employ or under the direct supervision and control of such master plumber shall be employed by another to alter, repair, make connections with or otherwise affect any drain, sewer line, waste line, vent pipe or other connection therewith.
B. 
No owner, builder, interested party or other person shall permit any plumbing work regulated by this chapter to be done by anyone other than a master plumber or a journeyman in such master plumber's employ or under the direct supervision and control thereof until a proper permit has been obtained.
At least 24 hours prior to the commencement of plumbing work by any person to whom or for whom a permit has been issued, the permittee or the plumber shall notify the Plumbing Inspector that the work is to commence and the date, time and place where the work is to be performed.
