This chapter shall be known as the "Village of Ballston Spa Noise Control
Law."
It is hereby declared to be the policy of the Village of Ballston Spa
to safeguard the right of its residents within the privacy of their homes
to be free from intrusive unwanted sounds. It is the policy of the Village
of Ballston Spa to establish standards and enforcement procedures and penalties
to resolve problems of noise which is disturbing to residents.

No person shall operate or cause to be operated any source
of sound in such a manner as to create a sound level which exceeds the limits
set forth for the receiving land use category stated below when measured at
or within the property boundary of the receiving land use:

For any source of sound which emits a pure tone, a discrete
tone or impulsive sound, the maximum sound limits set forth above shall be
reduced by five dBa.
The provisions of this chapter shall be enforced by the Police Department
of the Village of Ballston Spa.
Any person who violates any provision of this chapter shall be deemed
guilty of an offense and, upon conviction thereof, shall be punishable by
a fine not to exceed $250. Each day that a violation shall occur shall constitute
a separate offense.
