No person shall drink any alcoholic beverages
as defined in MGL C. 138, § 1, or possess an open container,
whether full or partly full of any alcoholic beverage, while on, in
or upon any public way, or upon any way to which the public has a
right of access, or in any place to which the public has a right of
access as invitees or licensees, in any park or playground, conservation
area or recreation area or on private land or place without the consent
of the owner or person control thereof. Whoever violates the provisions
of this section shall be fined.

It shall be unlawful for any person who has
not attained the legal drinking age as defined in MGL C. 138, § 34,
and is unaccompanied by his parent or guardian, to knowingly transport,
carry or have in his or her possession any alcohol or alcoholic beverage,
while on, in or upon any public way or upon any way to which the public
has the right of access, or in any place to which the public has a
right of access as invitees or licensees, in any park or playground,
conservation area or recreation area or place without the consent
of the owner or person in control thereof. This section shall not
apply to any person eighteen (18) years of age or older who knowingly
transports or carries on his person alcohol or alcoholic beverages
in the course of his employment.
Whoever violates the provisions of this chapter shall be fined. For penalty, see Chapter

The sale of alcoholic beverages in containers less than or equal
to 100 milliliters is prohibited within the Town of Falmouth. Effective:
October 1, 2021.
