This chapter is intended to protect and promote the health, safety and
comfort of the residents of the borough by regulating the disposal of garbage
and rubbish and refuse materials, ensuring that garbage shall be disposed
of solely in the borough dump, subject to adequate public control.
As used in this chapter, the following terms shall have the meanings
indicated:
The refuse or residue of animal or vegetable matter which has been
or may be used as food for man or beast and all refuse animal or vegetable
matter, including carcasses and parts of dead animals. It shall include fowl
manure, decayed vegetables, fruit or any condemned food or other waste organic
matter.
Includes all miscellaneous inorganic matter, such as bottles, rags,
mattresses, worn-out furniture, old clothes, old shoes, broken glass, leather,
carpets, crockery, metal, rubber, cut grass, leaves, tree branches, paper,
cardboard, lumber or any materials that may accumulate as the result of building
or manufacturing operations, as well as trade wastes.
All garbage and rubbish materials and refuse, as defined herein.
It shall be unlawful for any person to dump or otherwise deposit garbage
on any land, vacant or occupied, whether owned by the person or not, within
the borough, except at the borough dump.
A.
It shall be unlawful for any person to dump or otherwise
deposit rubbish material or refuse on any land within the borough, except
rubbish materials and refuse originating on the lands owned or occupied by
the person so disposing of or depositing such materials.
B.
Rubbish materials and refuse originating on the land
owned or occupied by the person so disposing of or depositing such materials
shall be suitably spread upon such lands and covered with clean earth or fill,
subject to the control and direction of the Board of Health. It shall be unlawful
to set fire to or burn waste materials without first obtaining the permission
of the Board of Health. The controlled burning of such waste materials pursuant
to such permit shall be permitted only during daylight hours, from 9:00 a.m.
to 5:00 p.m. of each day, exclusive of Sundays and holidays.
The Health Officer of the borough shall be entitled to inspect lands
upon which waste materials may be deposited, at any time, and to require proper
measures to be taken by the owner and operator thereof to control vermin,
flies, insects and other matters which may affect the health and sanitation
of the borough. It shall be the responsibility of the Health Officer, after
examination of the site, to enforce the rules and regulations herein provided
for the orderly and sanitary conduct of said disposal operations.
