of the Revised General Ordinances]
This article shall be known and may be cited as the "Carnival-Amusement
Rides Safety Ordinance."
As used in this article, the following terms shall have the meanings
indicated:
Any mechanical device or devices for which a permit is required pursuant
to the Carnival-Amusement Rides Safety Act, N.J.S.A. 5:3-31 et seq., and any
amendments thereto.
A carnival or an amusement ride classified as such by the Commissioner
of Labor of the State of New Jersey, or his/her designee, pursuant to N.J.S.A.
5:3-31 et seq.
A person who owns, leases, controls or manages the operations of
a carnival amusement ride, including the state and any of its subdivisions.
Any person or persons actually engaged in, or directly controlling,
the operations of a carnival or amusement ride.

Neither the owner nor ride operator of a major ride shall
permit a passenger who is under age 18 and under 60 inches in height on the
ride, except when the approved height restriction for the ride is less than
60 inches and the passenger meets it.
B.Â
This restriction shall apply notwithstanding the presence
of a guardian who indicates a desire or intention to accompany the minor passenger
on the ride.
