For the purposes of this article, the applicable definitions set forth
in § 102 of the Dog Law of the Commonwealth of Pennsylvania[1] and Chapter 84, Zoning, of the Code of the Township of Pine, be and the same are hereby adopted by reference as fully as though said definitions were set forth at length herein.

An Animal Control Officer, as may be designated by the Township of Pine,
from time to time, together with all police officers of the Pine-Marshall-Bradfordwoods
Joint Police Force, shall be authorized to enforce the provisions of the Dog
Law[1] of the Commonwealth of Pennsylvania and the provisions of this
article within the Township of Pine.

No person shall cruelly treat any dog or other domestic pet in the Township
of Pine. The term "cruel treatment" shall include any beating, intentional
infliction of injury or wound, underfeeding or the abandonment of any dogs
or other domestic pets.
It shall be unlawful for the owner of any dog or other domestic pet
to permit or allow the same to run at large within the Township of Pine. All
dogs and other domestic pets shall be kept under restraint at all times, either
by a leash not to exceed eight feet in length, held by the owner or a responsible
person or his agent, or by being kept within the exclusive premises of the
owner or his agent. Violation of the provisions of this section shall be deemed,
in addition to the provisions of the Dog Law[1] of the Commonwealth of Pennsylvania, a public nuisance of the
Township of Pine when such dog or other domestic pet is not under the restraints
required by the provisions of this section.

Excessive, continuous or untimely noisemaking by any dog or other domestic
pet, including but not limited to barking, howling, screeching, yelping or
baying which disturbs the quiet of any person or the community, or molesting
passersby, chasing motor vehicles or bicycles, habitual attacking of other
domestic animals or trespassing on public or private property shall all be
deemed public nuisances and a violation of the provisions of this article.
It shall be the duty of the owner of any dog or other domestic pet in
the Township of Pine to have such inoculated against rabies and to provide,
upon request by an authorized representative of the Township of Pine, a certificate
of effective current inoculation by a veterinarian. The failure to comply
with the provisions of this section shall be deemed a violation of this article.
No dogs or other domestic pets, whether under restraint or otherwise,
are permitted within the public buildings of the Township of Pine. Any person
with defective eyesight or hearing who relies upon a dog specifically trained
to assist them with such functions shall be exempt from the provisions of
this section.
It shall be the duty of the owner (or his agent) of a dog or other domestic
pet to promptly remove such animal's excrement from any property beyond the
premises of the owner and to clean any such affected area immediately. For
the enforcement of the provisions of this section, an owner or his agent accompanying
a dog or other domestic pet under proper restraints, as required under the
provisions of this article, shall carry on his person the materials necessary
to comply with the provisions of this section. Any owner of a dog or other
domestic pet (or his agent) who fails to so promptly remove or clean such
animal's excrement or to have available materials for this purpose shall be
deemed in violation of this article.
Insofar as the private property of the owner or his agent is concerned,
dog or other domestic pet excrement found on such property which causes noxious
odors because of the owner's or his agent's failure to dispose of or clean
such excrement from his property shall constitute a public nuisance of the
Township of Pine and a violation of the provisions of this article.
Any person, firm or corporation who or which operates a kennel (as such is defined in § 84-5 of the Code of the Township of Pine) within the limits of the Township of Pine shall secure a kennel license. The enforcement officer or police officers of the Pine-Marshall-Bradfordwoods Joint Police Force shall periodically inspect such kennels to determine the safety and the sanitary and health conditions of such kennel. No dog or other domestic pet shall be permitted to remain at any kennel unless a certificate of a duly authorized veterinarian is produced indicating that such dog or other domestic pet has been inoculated against rabies within the past three years. The Board of Supervisors may establish rules and regulations for the operation of a kennel within the Township of Pine. The fee for the issuance of a kennel license shall be $100 and such may be amended from time to time by resolution of the Board of Supervisors.
Nothing contained in the provisions of this article shall be construed
as an abrogation of any of the statutes of the Commonwealth of Pennsylvania
which deal with animals and, further, the compliance with any ordinance or
statute otherwise requiring application for an animal license or registration
or the payment of a fee for the same shall not bar enforcement of the provisions
of this article.
Any person who is in violation of any of the provisions of this article,
upon conviction thereof before a District Justice, shall be sentenced to pay
a fine of not less than $25 nor more than $300, together with the costs of
prosecution. Each violation shall be considered a separate offense and shall
be deemed committed on each day during or on which a violation occurs or continues.
