It is hereby declared and found that litter carelessly deposited in the Township of Shaler is the cause of civic disgrace; that litter is a health, fire and safety hazard and a pollutant; that an all-out litter-control campaign can result in substantial savings to the taxpayers of the Township of Shaler; that the First Class Township Code authorizes regulations to prevent the accumulation of manure, compost and the like and to prohibit the accumulation of ashes, garbage, rubbish and other refuse materials upon private properties, including the imposition and collection of reasonable fees and charges for the collection, removal and disposition thereof; and that litter and leaf waste and grass clippings is a matter affecting the public interest, and consequently should be subject to supervision and administrative control for the purpose of safeguarding the public health, safety and general welfare of the people of the Township of Shaler.
No person shall throw, discard, leave, emit, deposit or allow the depositing of any litter or leaf waste or grass clippings in or upon any street, sidewalk or other public place or right-of-way within the Township except in public receptacles or in private receptacles for collection.
All persons shall place litter in public or private receptacles and shall do so in such a manner as to prevent the litter from being carried or deposited by the elements upon any street, sidewalk or other public place or upon private property.
No person shall sweep or deposit in any gutter, street or other public place or right-of-way within the Township the accumulation of litter from any building, litter from any public sidewalk or driveway, or leaf waste, grass clippings or branches from any private property.
No person while a driver or passenger in a vehicle shall throw, discard, emit, deposit or allow the depositing of litter upon any street or public place within the Township or upon private property.
No person shall drive or move any truck or other vehicle within the Township unless such vehicle is so constructed or located as to prevent any load, contents or litter from being blown or deposited upon any street, alley or other public place, nor shall any person drive or move any vehicle or truck within the Township, the wheels or tires of which carry onto or deposit in any street, alley or other public place mud, dirt, sticky substances, litter or foreign matter of any kind.
No person shall throw, discard, emit, deposit or allow the depositing of litter in any park within the Township except in public receptacles and in such a manner that the litter will be prevented from being carried or deposited by the elements upon any part of the park or upon any street or other public place. Where public receptacles are not provided or are filled to capacity, all such litter shall be carried away from the park by the person responsible for its presence and properly disposed of elsewhere, as provided herein.
No person shall throw, discard, emit, deposit or allow the depositing of litter in any fountain, pond, stream, creek or any other body of water in a park or elsewhere within the Township.
No person shall discard or dump along any public place any household or commercial solid waste, leaf waste, rubbish, refuse, junk, vehicle or vehicle parts, rubber tires, appliances or furniture that is not specifically designated for the purpose of solid waste storage or disposal.
No person shall throw, discard, emit, deposit or allow the depositing of litter on any occupied private property or commercial place within the Township, whether owned by such person or not, except that the owner or person in control of such private property or commercial place may maintain authorized private receptacles for collection in such a manner that litter will be prevented from being carried or deposited by the elements upon any street or other public place or upon any private property.
Each owner or person in control of any commercial place, including shopping centers and delivery and parking areas at such location, shall keep said places, parking areas, delivery areas and other open areas which are a part of such commercial place free from litter.
The owner or person in control of any private property shall at all times maintain the premises free of litter; provided, however, that this section shall not prohibit either the storage or the placement of litter, refuse, rubbish, trash or recycling materials in proper storage receptacles on private premises by the owner for collection.
No person shall throw, discard, emit, deposit or allow the depositing of litter on any open or vacant private property within the Township, whether owned by such person or not.
A. 
The Township Building Inspector or his designee is hereby authorized and empowered to notify the owner and/or occupant of any open or vacant private premises or any occupied or unoccupied private or business premises within the Township, or the agent of such owner or occupant, to properly dispose of litter located on such property. Such notice shall be by certified mail, addressed to said owner and/or occupant at his last known address, or served personally by the Township Building Inspector or his designee upon such owner or occupant.
B. 
Upon the failure, neglect or refusal of any owner or occupant so notified to properly dispose of litter within three days after receipt of the written notice provided for in Subsection A above, or three days after the date of such notice in the event that the same is returned unserved, said Township Building Inspector or his designee is hereby authorized and empowered to order the correction of such violation, using Township funds or Township personnel to accomplish such correction, and may charge the costs thereof to the violator. Collection of such costs by the Township may be made by lien or otherwise as authorized by law.
Any person who deposits or otherwise disposes of any garbage, litter, leaf waste, refuse, rubbish or trash or any other thing or substance in violation of this chapter shall, upon conviction, be subject to pay a fine not exceeding $600, plus costs of prosecution, or imprisonment for a term not exceeding 15 days, or to both such fine and imprisonment. The continuation of any violation against the provisions of this chapter shall constitute, for each day the violation is continued, a separate and distinct violation hereunder.
