The purpose of this article is to provide for
the annexation by the City of certain territory of the Town and Village
in accordance with and pursuant to Article 17 (the Municipal Annexation
Law) of the General Municipal Law of the State of New York. It is
the intent of this article to permit the City to complete the annexation
of such territory based upon the following:
A.Â
The governing board of the City, at a meeting held
on December 17, 2007, as required by law having made a negative declaration
under the State Environmental Quality Review Act and thereby having
determined that the proposed annexation will not result in any adverse
environmental impacts;
B.Â
The governing board of the City, at a meeting held
on January 28, 2008, as required by law having made the necessary
findings and order that the proposed annexation is in the overall
public interest, and the filing thereof in the offices of the clerks
of the Village and Town, together with all other documents required
pursuant to Article 17 (the Municipal Annexation Law) of the General
Municipal Law;
C.Â
The governing board of the Town, as required by law
having made the necessary findings and order that the proposed annexation
is in the overall public interest, and the filing thereof in the offices
of the affected governments;
D.Â
The governing board of the Village, as required by
law having made the necessary findings and order that the proposed
annexation is in the overall public interest, and the filing thereof
in the offices of the clerks of governments.
In accordance with and pursuant to Article 17
(the Municipal Annexation Law) of the General Municipal Law of the
State of New York, the City hereby annexes the following described
territory situated within the Town and the Village, and thereupon,
the City shall contain and include such property in addition to all
of the territory heretofore contained within its boundaries:
All that tract or parcel of land, situate in
the Town of Hornellsville, Village of North Hornell, County of Steuben,
State of New York, more particularly described as follows:

Bethesda Drive and the easterly line of New
