No person or corporation shall operate a taxi
or livery service having its principal place of business within the
City of Marlborough without first obtaining a taxi and/or livery service
license issued by the City Council. An applicant for an original license
shall, at the time of application, pay a fee of $100 and the cost
of any required publications. For a renewal of the license, the applicant
shall pay a fee of $50 and the cost of any required publications.
A.Â
If issued by the City Council, a license shall specify:
(1)Â
The type or types of service for which the holder
is licensed;
(2)Â
The address of the authorized principal place of business;
(3)Â
The number of taxi and/or livery vehicles that may
be stored or garaged at the principal place of business; and
(4)Â
Such other terms, conditions or restrictions relating
to the principal place of business and/or the operation of the taxi
and/or livery service as the City Council may deem appropriate.
B.Â
No license holder shall fail to fully comply with
the terms, conditions and/or restrictions of the license.
C.Â
The City Clerk shall, upon issuance of a license or
an amendment or modification thereto, provide the Chief of Police
and Building Commissioner with a copy of same.

An original or renewal license shall be valid
for two years from the date of issuance.
A license holder may, during the life of a license,
petition the City Council to modify or amend such license. At the
time of submitting such petition, the license holder shall pay a fee
of $25 and the cost of any required publications.
The City Council may, for cause, suspend or
revoke a taxi and/or livery service license.
A.Â
A taxi or livery service having its principal place
of business within the City of Marlborough must be operated in strict
conformity with Massachusetts law, the Code of the City of Marlborough
and such rules and regulations regulating taxi and/or livery services
as may be promulgated by the Registrar of Motor Vehicles.
B.Â
Any taxi or livery vehicle being operated within the
City of Marlborough must strictly conform to the vehicle standards
and insurance requirements established by Massachusetts law and such
rules and regulations regulating taxi or livery vehicles as may be
promulgated by the Registrar of Motor Vehicles.
At least every two years, each holder of a taxi
and/or livery license shall conduct a driver history and criminal
history background check of each person employed as a driver. During
normal business hours, the Chief of Police or his designee may, as
a condition of the license, inspect such background check documentation.
Any person or corporation found guilty of violating
any provision of this chapter shall be punished by a fine of $300
per offense.
