The Town Board of the Town of Greenville believes that it is appropriate for the Town of Greenville to enact a local law dealing with vehicle and traffic matters within the Town of Greenville. While the Town Board acknowledges that the primary responsibility for vehicle and traffic legislation rests with the New York State Legislature, there are many matters of local concern which can be regulated by a local law adopted by the Town of Greenville. This chapter is promulgated to establish local control and local regulation over some of the matters which are subject to local regulation. This chapter is proposed in a format which will permit easy amendment as additional matters are presented to the Town Board from time to time.
A. 
The words and phrases used in this chapter shall have the meanings respectively ascribed to them by Article 1 of the Vehicle and Traffic Law of the State of New York.
B. 
The following words and phrases, which are not defined by Article 1 of the Vehicle and Traffic Law of the State of New York, shall have the meanings respectively ascribed to them in this chapter for the purposes of this chapter:
CURBLINE
The prolongation of the lateral line of a curb or, in the absence of a curb, the lateral boundary of the pavement or the traveled portion of the right-of-way, whichever is wider.
HOLIDAYS
New Year's Day, Lincoln's Birthday, Washington's Birthday, Memorial Day, Independence Day, Labor Day, Columbus Day, Election Day, Veterans Day, Thanksgiving Day and Christmas Day or days celebrated as such.
OFFICIAL TIME STANDARD
Whenever certain hours are named herein or on traffic control devices, they shall mean the time standard which is in current use in this state.
The Superintendent of Highways shall provide for the installation and maintenance of traffic control devices when and as directed by the Town Board and as required under theprovisions of this chapter to make effective the provisions of this chapter and may install and maintain such additional traffic control devices as he may deem necessary to regulate, warn or guide traffic under the Vehicle and Traffic Law of the State of New York, subject to the provisions of §§ 1682 and 1684 of that Law.
The following streets or parts of streets are hereby designated as one-way streets, and vehicles shall proceed only in the direction indicated within the limits designated below:

The parking of vehicles on Town roads is prohibited at all times.
A. 
All trucks, tractors and/or tractor-trailer combinations in excess of the gross weight indicated below are hereby excluded from the following highways within this Town:

B. 
Exceptions. The regulations established under this section shall not be construed to prevent the delivery or pickup of merchandise or other property along the highways from which such vehicles and combinations are otherwise excluded.
A. 
Authority to remove vehicles. The Town Superintendent of Highways shall have the power to remove or cause the removal of any vehicle:
(1) 
Parked or abandoned on any highway within this Town during a snowstorm, flood, fire or other public emergency which affects that portion of the public highway upon which said vehicle is parked or abandoned.
(2) 
Found unattended on any highway within this Town where said vehicle constitutes an obstruction to traffic.
(3) 
Parked or abandoned on any highway within this Town where parking is prohibited.
(4) 
Left unattended for more than 24 hours within the right-of-way of any highway or other public property within the Town.
B. 
Disposition of abandoned vehicles. The disposition of abandoned vehicles shall be made in accordance with the provisions of the Vehicle and Traffic Law of the State of New York.
C. 
In any calendar year the Town Board of Town of Greenville shall have the right to convert to use by the Town of Greenville not more than two unclaimed abandoned vehicles which had number plates affixed at the time of abandonment.
D. 
No more than one inoperative or unlicensed motor vehicle shall be parked, kept, or stored on any premises and not more than one vehicle shall at any time be in a state of major disassembly, disrepair, or in the process of being stripped or dismantled.

Every person convicted of a traffic infraction for an offense against any provision of this chapter which is not an offense against any provision of the Vehicle and Traffic Law of the State of New York shall, for a first conviction thereof, be punishable by a fine of not more than $100 or by imprisonment for not more than 15 days, or by both such fine and imprisonment; for a second conviction for the same offense within 18 months thereafter, such person shall be punishable by a fine of not more than $200 or by imprisonment for not more than 45 days, or by both such fine and imprisonment; and upon a third or subsequent conviction for the same offense within 18 months after the first conviction, such person shall be punishable by a fine of not more than $300 or by imprisonment for not more than 90 days, or by both such fine and imprisonment.

This chapter shall take effect upon compliance with the provisions of the laws of the Town and the Municipal Home Rule Law, except those parts, if any, which are subject to approval under § 1684 of the Vehicle and Traffic Law of the State of New York this chapter shall take effect as provided by law. Any part or parts of this chapter which are subject to approval under § 1684 of the Vehicle and Traffic Law shall take effect from and after the day on which approval, in writing, is received from both the New York State Department of Transportation and New York State Department of Public Works.
