The Town recognizes that economic factors have substantially reduced the local applicant pool relative to positions requiring extensive and/or highly technical experience. In order to bring qualified persons to the Town for employment it is necessary to modify the residency requirements to include persons residing anywhere within the State of New York.
A. 
Authority. This section is adopted pursuant to the provisions of the New York State Municipal Home Rule Law § 10, which grants to local governments the authority to enact local laws which are not inconsistent with the New York State Constitution or general laws. This section recognizes that the New York State Public Officers Law § 3 was, by the addition of § 3, Subdivision 24, rendered a special law with respect to the residency requirement for appointed Town officers.
B. 
Supersession of statute. This section shall supersede § 23 of the New York State Town Law and § 3 of the New York State Public Officers Law insofar as they are inconsistent with this section.
C. 
Residency requirement. All appointed officers of the Town of North Hempstead shall reside in the State of New York.
