A. 
Districts established. For the purpose of this chapter, the following primary use districts as found in this article are hereby established within the Village of Theresa.
B. 
Zoning Map. A certified copy of the Official Zoning Map shall be adopted and approved with this text as a part of this chapter and shall bear upon its face the attestation of the Village President and the Clerk-Treasurer of the Village of Theresa and shall be available to the public in the office of the Clerk-Treasurer.
A. 
Purpose. The primary purpose of this district shall be to promote an area of a generally exclusive single-family residential nature.
B. 
Permitted uses and structures:
(1) 
Single-family dwellings.
(2) 
Accessory buildings, including private garages and buildings clearly incidental to the residential use of the property, provided that no such accessory buildings may be used as dwelling units.
(3) 
Forestry.
(4) 
General farming and necessary farm-related structures, except farms operated for the disposal of sewage, garbage, or offal.
(5) 
Truck gardening, nurseries and greenhouses only for the growing of plants.
(6) 
Telephone, telegraph and power distribution poles and lines and necessary appurtenant equipment and structures.
(7) 
Parks and playgrounds.[1]

C. 
Conditional uses and structures:
(1) 
Bed-and-breakfast establishments.

Cemeteries.
(3) 
Churches, including those related structures located on the same site which are an integral part of the church operation.
(4) 
Day-care centers, when required to be licensed by an agency of the state, where a person provides, for compensation, care and maintenance of four or more children at a location other than the child's own home or the home of relatives or guardians.
(5) 
Golf courses.
(6) 
Governmental and cultural uses, such as fire and police stations, community centers, libraries, post office, village hall, museums, sewage disposal plants, historical sites and buildings for the storage of road maintenance equipment.
(7) 
Planned unit developments.
(8) 
Public and private schools.
(9) 
Utilities.
(10) 
Home occupations subject to the standards in § 350-44 and professional offices as defined in § 350-110.

D. 
Area, height and yard requirements.
(1) 
Lot. Width and area of all lots shall be determined in accordance with § 350-12.
(2) 
Height. Maximum height: 35 feet.
(3) 
Yards. See § 350-12.

Uses conditionally allowed in the R-1 Residential District.
(2) 
Multiple-family dwellings.
(3) 
Mobile home parks.
D. 
Area, height and yard requirements.
(1) 
Lot. Width and area of all lots shall be determine in accordance with § 350-12, except that lots for two-family dwellings shall be a minimum of 12,500 square feet in area and lots for multiple-family dwellings shall contain not less than 5,000 square feet per dwelling unit.
(2) 
Height. Maximum height: 35 feet.
(3) 
Yards. See § 350-12.

(1) 
Appliance sales and service.
(2) 
Automobile sales and service.

Dry-cleaning establishments.
(6) 
Eating and drinking establishments.
(7) 
Farm machinery sales and service.
(8) 
Funeral homes.
(9) 
Garages for storage of vehicles used in conjunction with a permitted use.
(10) 
Gas stations.
(11) 
General farming, except farms operated for the disposal of sewage, rubbish or offal.
(12) 
Hotels.
(13) 
Laundromats.
(14) 
Medical and dental clinics.
(15) 
Nurseries and greenhouses.
(16) 
Parking lots.
(17) 
Personal and business service establishments.
(18) 
Private clubs and lodges.
(19) 
Professional offices and studios.
(20) 
Public transportation terminals.
(21) 
Retail stores or shops.
(22) 
Theaters, except drive-ins.
(23) 
Videotape rental and sales.
(24) 
Any similar use subject to the approval of the Village Board.
C.

(1) 
Animal hospitals and veterinary clinics.
(2) 
Churches.
(3) 
Day-care centers, when required to be licensed by an agency of the state, where a person provides, for compensation, care and maintenance of four or more children at a location other than the child's own home or the home of relatives or guardians.
(4) 
Planned unit developments.
(5) 
Residential quarters for the owner, proprietor, commercial tenant, employee or caretaker located in the same building as the business.
(6) 
Single-family residences, but only in conjunction with and accessory to another permitted use.
(7) 
Utilities.

Governmental and cultural uses, such as fire and police stations, community centers, libraries, post office, village hall, museums and historical sites or structures.

Residential quarters for the owner, proprietor, commercial tenant, employee or caretaker located in the same building as the business.

Rear: minimum 10 feet.

Street: there shall be no minimum street setback.
(c) 
Side: there shall be no minimum side yard, except where a lot abuts a residential zoning district; in such case the minimum side yard shall be the same as the adjoining district.

B. 
Permitted uses and structures:
(1) 
Automobile repair shops.
(2) 
Commercial greenhouses and nurseries.
(3) 
Contractors' offices.
(4) 
Farm machinery repair shops.
(5) 
Feed mills, granaries and elevators.
(6) 
Food storage warehouses.
(7) 
Freight yards and terminals.[1]

Manufacturing establishments engaged in the fabrication, processing, assembly or packaging of a product which is not specified as a conditional use in the I-1 Industrial District.
(12) 
Printing and publishing establishments.
(13) 
Processing and packaging of food products.
(14) 
Storage and sale of machinery and equipment.
(15) 
Telephone and power distribution poles and lines.
(16) 
Trucking companies.
(17) 
Warehousing, except the storage of chemicals, explosives, flammables and radioactive materials.
(18) 
Wholesale establishments. Retail sales of the products produced on the premises are permitted if accessory to and in the same structure as the principal use.
(19) 
Any similar use subject to the approval of the Village Board.
C. 
Conditional uses and structures:
(1) 
Automobile salvage yards and storage of inoperable vehicles.
(2) 
Incinerators.
(3) 
Junk or scrap storage yards.
(4) 
Manufacturing, processing, packaging or storage of chemicals, explosives, batteries, asphalt, cement, flammables, paint, poison, rubber, dyes, plastics and radioactive materials.
(5) 
Mineral extraction and quarrying.
(6) 
Oil and coal refineries.
(7) 
Planned unit developments.
(8) 
Stockyards.
(9) 
Utilities.
(10) 
Watchman's quarters.
(11) 
Any use listed as permitted or conditional in the C-1 Commercial District.
(12) 
Any other trade, industry or use, without limitation because of prior enumeration, that is noxious, offensive or in conflict with neighboring uses for reasons of smoke, odors, noise, vibration, dust, health hazards or possibility of accident.
D. 
Area, height and yard requirements.
(1)

(2) 
Height. Maximum height: 60 feet.

Purpose. The primary purpose of this district is for uses compatible with protecting, preserving and enhancing the river, wetlands and areas subject to flooding within the Village.
B. 
Permitted uses and structures:
(1) 
General farming, provided that no drainage, filling or dredging takes place and no farm buildings are constructed.
(2) 
Grazing.
(3) 
Harvesting of any wild crop such as marsh hay, ferns, moss, wild rice, berries, tree fruits and tree seeds.
(4) 
Hiking trails and bridle paths.
(5) 
Hunting and fishing preserves.
(6) 
Nonresident buildings used solely in conjunction with the raising of waterfowl, minnows, and other similar lowland animals, fowl or fish.
(7) 
Public and private parks, picnic areas, golf courses and similar uses.
(8) 
Sustained-yield forestry.
(9) 
Telephone, telegraph and power transmission lines and necessary appurtenant equipment.
C. 
Conditional uses and structures. The following uses, structures and activities are permitted upon issuance of a conditional use permit as provided in Article V of this chapter and issuance of a Department of Natural Resources permit, where required, provided that such uses will not increase the flood hazard to life or property and will not be adverse to the environment or value of the area. All conditional use permits shall be granted only upon a finding by the Village Board that such use or structure will not restrict a floodway or destroy the storage capacity of a floodplain.
(1) 
Dams.
(2) 
Filling, drainage or dredging of wetlands or floodplain areas.
(3) 
Flowages and wildlife ponds.
(4) 
Growing and harvesting of cranberries.
(5) 
Piers, docks and boathouses.
(6) 
Power plants.
(7) 
Relocation of any watercourse.
(8) 
Removal of topsoil or peat.
(9) 
Utilities.
