As used in this article, the following terms shall have the meanings indicated:
AGE
The individual's age on July 1 of each season.
AREA
The total area belonging to the Township.
POOL APRON
The prepared concrete deck immediately surrounding the water surface of the various pools.
POOL AREA
The entire fenced area surrounding the pool.
POOL PATIO
The prepared concrete deck adjoining the refreshment area and the pool building.
RESIDENT
A person who dwells permanently or continually within the confines of the Township.
Membership is limited to residents of Maplewood and to a maximum of 8,000 persons. In addition, there shall be issued swimming privileges to waiting list limited family memberships and to waiting list limited individual memberships. Both classifications shall not exceed 500 persons. Memberships shall not be transferable. All applications in excess of membership capacity will be placed on the waiting list. As vacancies occur, applications will be taken from the waiting list in the sequence in which they were received. All waiting list limited memberships shall be taken from the general waiting list in the sequence in which the respective application was filed.

The following is a list of the types of membership for the community pool:
A. 
Family membership includes up to two cohabitating adults, or widow or widower, and all children, natural or adopted, unmarried and living at home, including state ward children, who are not yet 21 years of age on July 1 of the membership year.
B. 
Individual membership is available to any individual resident.
C. 
College membership is available to any individual 21 years of age to and including 25 years of age who is a full-time college student. Proof of full-time attendance at college must be submitted in order to be eligible for college membership.
D. 
Waiting list limited family membership shall entitle the eligible members of this designation to use the pool during the general swim period only, for a period of five days each week. These days shall commence on Monday and conclude on Friday, excluding holidays. Waiting list limited family membership shall include the same classification of persons as the regular family membership.
E. 
Waiting list limited individual membership shall also be available under the same terms and conditions as the waiting list limited family membership.
F. 
Servicemen or servicewomen who are now residents of Maplewood, who had a Maplewood home address at the time of entry into active service and who apply for pool membership within 12 months of their date of honorable discharge from active service shall be allowed a priority to purchase pool membership which may include their spouse and children. Proof of discharge (Defense Department Form DD No. 214, Report of Separation) must be submitted at the time of application for this privilege. Fees governing said application shall be as set forth in § 193-13 of this article.
A. 
All members upon proper identification being presented to the pool office shall be entitled to use the facilities.
B. 
There shall be no regular guest privileges. Special guest privileges shall be extended to:

(1) 
Active duty servicemen. Active duty servicemen on leave, pass or furlough who have been permanent residents of the Township of Maplewood for at least two previous years before the pool season may request a temporary badge from the recreation office or the pool manager's office at no fee upon the presentation of proof of leave, pass or furlough. This permission granted to active duty servicemen shall not include any member of the servicemen's families.
(2) 
Children under 21 years of age of a divorced or separated parent who are visiting said divorced parent, and provided that the divorced parent is a member of the pool, shall be permitted to use the pool facilities, provided that said parent who is a member submits a written request for said permission to the Township Clerk. Upon receipt of said written request and provided that said parent is eligible, a special temporary badge will be issued, which badge shall not be transferable and shall be returned to the pool office at the end of the pool day.

(3) 
Pool privileges shall be awarded to bona fide foreign students who shall have been in the United States for a period of six months. Said foreign students must be residing with a pool member and shall submit a letter from a local sponsoring organization attesting to his residence and to the fact that he is a bona fide foreign student.

The Director of the Department of Community Services, in consultation with the Township Administrator, is authorized to open the Maplewood Community Pool to all Maplewood residents, whether they are or are not pool members, when weather forecasts call for a period of extreme heat, i.e., a period of high heat and humidity with temperatures above 90 degrees for at least three consecutive days. When the period of extreme heat has ended, membership regulations shall be enforced.

Any member resigning his or her membership for medical reasons may apply for reinstatement upon submission of a certificate from his or her physician. Said member may be granted a one-year leave of absence for membership, if the same is requested by March 1 of each year. Such leave of absence may be renewed, if requested in writing, for one additional year after the first request.
Any person who violates these rules and regulations shall be subject to immediate ejection from the area by the official in charge and his membership subject to revocation or suspension by the Township.

The Township Committee, with the advice and recommendation of the Pool Advisory Committee, shall set the hours of operation of the Maplewood Community Pool.

A. 
The fees to be charged for membership in the community pool shall be as provided in Chapter 123, Fees.
B. 
Membership fees shall be due within 30 days upon receipt of the application, unless otherwise specified on the bill. In the event that the same is not paid on the due date, there shall be an additional charge as provided in Chapter 123, Fees, for each of the foregoing memberships, which charge shall be known as a "late charge."
C. 
No fees are returnable for any reason after opening day of each season.
D. 
Members shall pay a fee for lockers. The locker fee shall be as provided in Chapter 123, Fees, for each use of the lock.
E. 
Any pool member who has reached the age of 65 by July 1 of the current pool year shall be granted a credit as provided in Chapter 123, Fees, against his pool membership fee upon furnishing satisfactory proof of age in person to the Township Clerk at the time of application for membership.

Guest passes are hereby authorized on the following conditions:
A. 
Each member shall be entitled to purchase a book of five guest passes for a fee of $25.
B. 
There shall be no more than 100 guests allowed at the pool per day.
C. 
Each sponsoring pool member must accompany the guest and shall be responsible for the guest's conduct at the pool and shall also see that the guest observes all rules and regulations.

The Township Committee, with the advice and recommendation of the Pool Advisory Committee, shall set rules and regulations with regard to identification badges.

The Township Committee, with the advice and recommendation of the Pool Advisory Committee, shall promulgate rules and regulations for the Maplewood Community Pool.
The following shall be prohibited in the pool area:
A. 
No glass or metal containers may be brought within the pool area.
B. 
No alcoholic beverages will be permitted in the area.
C. 
No playpens and sun umbrellas, known as a "clamp-on" type, fastened to chairs, and not those that are freestanding or sunk into the ground, shall be permitted.
D. 
No wrestling, running, ballplaying or other similar activity within the pool apron and parking area will be permitted. Gambling, vulgarity and other objectionable conduct will result in disciplinary action by the management.
E. 
No cardplaying will be permitted in the picnic area. No gumchewing shall be permitted in the entire pool area.
F. 
No person shall be permitted to wear eyeglasses or sunglasses while in the pool except upon receiving special permission from the pool manager.
G. 
No pets or animals will be permitted in the pool area.
H. 
No blowing of horns or loitering will be permitted in the area.
I. 
Smoking shall be permitted only in an area designated by the Recreation Department in consultation with the Pool Advisory Committee.

J. 
No roughness, rowdiness, profanity or other conduct affecting the safety and comfort of others will be permitted in the pool area.
A. 
Regulations shall be posted at the pool and strictly enforced.
B. 
The pool manager or the assistant manager may close or limit the swimming facilities or establish additional rules and regulations whenever, in his judgment, such action is deemed necessary or desirable for the protection of health or safety of persons entitled to use such facilities.
C. 
Members of the Police Department of the Township, the pool manager and the assistant manager and all lifeguards, when on duty at the swimming facilities, shall have authority to prohibit any action or conduct which they may consider to be dangerous, improper or immoral and any act or actions in violation of the applicable rules and regulations.
