This chapter shall be known and referred to as the "Small Motorized Vehicular Ordinance of the Village of Canastota."
As used in this chapter, the following terms shall have the meanings indicated:
SMALL MOTORIZED VEHICLES
Includes minibikes, dirt bikes, mopeds or other types of motorized bicycles or miniature motorcycles. This chapter does not regulate compact or subcompact cars licensed and regulated by the New York State Department of Motor Vehicles.
VILLAGE
The Village of Canastota, a municipal corporation, and the territorial limits thereof as they presently exist or as they may hereafter be duly extended.
The following rules and regulations shall govern within the Village of Canastota:
A. 
Operation of all small motorized vehicles is prohibited on or over all properties owned by the Village of Canastota except such village streets and highways used as public vehicular thoroughfares.
B. 
Operation of all small motorized vehicles is prohibited from all sidewalks and other thoroughfares reserved for pedestrian traffic within the village.
C. 
No person shall operate a small motorized vehicle within the village between the hours of 12:00 midnight and 6:00 a.m. of the following day.
D. 
No person shall operate a small motorized vehicle within the village in excess of 15 miles per hour.
E. 
No person shall operate a small motorized vehicle within the Village of Canastota in such manner as to cause unnecessary or unusual noise of such character, intensity or duration as to endanger public comfort or peace, and such operation is described to be a nuisance and prohibited. All small motorized vehicles must be equipped with an adequate muffler and exhaust system in constant operation and regularly maintained to prevent any unnecessary noise. The muffler and exhaust system must reduce sound levels below 105 decibels in accordance with the stationary test method of the Motorcycle Industry Council.
F. 
No person shall operate a small motorized vehicle on any of the streets or highways within the village except on the extreme right-hand side of said streets or highways with allowance being made to pass parked vehicles.
Any person who shall violate any section of this chapter shall be guilty of a violation and punished as follows:
A. 
First offense under this chapter: a fine not to exceed $25.
B. 
Second offense under this chapter: a fine no less than $25 and no greater than $75.
C. 
Third offense or greater: a fine not to exceed $250 or imprisonment no greater than 15 days, or both.
This chapter is in addition to all applicable laws of the State of New York and in no way is to conflict with said laws, and this chapter shall be construed accordingly. Any section of this chapter or part thereof which conflict with any state law does not invalidate any other section of this chapter or part thereof.
