The Town Clerk of the Town of Glen may issue a permit for the conducting of games of chance in the corporate limits of the Village of Fultonville, New York, as authorized by the Constitution of the State of New York and by § 187 of the General Municipal Law. Such permit shall be issued only in accordance with state law and subject to the same conditions or limitations imposed on the conduct of games of chance in the unincorporated area of the town.
This chapter shall remain in effect until superseded or repealed as provided in state law and the Town Clerk shall have the authority granted by this law only so long as the Clerk has authority to issue permits in the unincorporated area of the Town of Glen.
This chapter does not take effect until 45 days after its adoption, nor until approved by the affirmative vote of a majority of the qualified electors of the Village of Fultonville voting on a proposition for its approval, if, within 45 days after its adoption, there is filed with the Village Clerk/Treasurer a petition signed and acknowledged in the manner required by the Municipal Home Rule Law and Article 9 of the Village Law, protesting against such chapter and requiring that it be submitted to the electors of such village for this approval or disapproval.[1]
