As used in this chapter, the following terms
shall have the meanings indicated, unless a different meaning clearly
appears from the context:
Unless specifically limited, shall be deemed to include all
parks, playgrounds, recreation areas, playing courts, athletic fields,
open spaces, recreation structures and facilities and all other land,
property or structures owned, managed, maintained and regulated by
the Township for park purposes.

Any natural person, corporation, organization of persons,
company, association or partnership.
The carrying by a person of a lighted cigar, cigarette, pipe
or other lighted smoking device.

The following rules and regulations are applicable
to all Brighton Township park and recreation areas.
A.
The parks are open to all Township residents and guests
daily from sunrise until sunset throughout the year, except for special
events authorized by the Board of Supervisors and/or Park and Recreation
Board and where rental of park facilities specifies a later time.
B.
The following activities are prohibited in all Brighton
Township park and recreation areas:
(1)
Possession and/or use of malt or alcoholic beverages
or drugs which are possessed in violation of law, except the use of
malt or alcoholic beverages in locations approved by the Board of
Supervisors and authorized by permit or rental agreement.
(2)
Being under the influence of malt or alcoholic beverages
or drugs.
(3)
Boisterous, immoral or indecent conduct.
(4)
Using threatening, abusive, insulting, profane or
obscene language or words.
(5)
Disturbing the peace by any conduct so as to annoy
any other person using the park for recreational purposes.
(7)
Discarding of trash, garbage or other litter except
into containers provided for that purpose.
(8)
Damaging, defacing, destroying or moving Township-owned
property, trees, shrubs, plants, turf, signs, buildings, structures,
lights, fixtures, equipment or other material or property of the Township.
(9)
Contamination of any waterway.
(10)
Fires, except in facilities provided for such purposes.
(11)
Dogs or horses or any other domesticated animals.
(12)
Minibikes, motorcycles, snowmobiles, go-carts, ATVs
or other self-propelled vehicles, other than automobiles in parking
areas.
(13)
Bicycles on or around any playing field or surface.
(14)
Hitting of golf balls on any playing field or surface.
(15)
Climbing on fences, backstops or buildings.
(16)
Injuring, defacing, destroying or removing any notice,
rule or regulation posted at any place within the park by authority
of the Board of Supervisors and/or Park and Recreation Board; or the
posting of any notice or placard within the park other than by authority
of the Board of Supervisors and/or Park and Recreation Board.
(17)
Setting up of any booth, table or stand for the sale
of any article or service whatsoever within the limits of the park
without permission of the Board of Supervisors or the Park and Recreation
Board; distributing, selling, servicing or renting any services or
commodity or soliciting for any purpose without permission of the
Board of Supervisors or the Park and Recreation Board.
(18)
Operating commercial vehicles, unless providing services
authorized by the Board of Supervisors and/or Park and Recreation
Board.
(19)
Carrying or discharging any firecrackers, fireworks or other pyrotechnics.

(20)
Disobeying a proper order of a police officer or disobeying
or disregarding or failing to comply with a rule or regulation, warning,
prohibition, instruction or direction given by an authorized person
and posted or displayed by sign, notice, bulletin, card or poster
or when notified or informed as to its existence by an authorized
person.
(21)
Hunting in areas designated as no hunting by the posting
of the property in compliance with Pennsylvania Game and Wildlife
Code.[2] Hunting on properties covered by this chapter shall be
in accordance with Pennsylvania game laws. Pavilions, dugouts, playgrounds,
comfort stations, courts and lodges shall be considered buildings
and subject to the one-hundred-fifty-yard safety zone area as specified
in the Pennsylvania game laws.

(22)
Cleaning, polishing, greasing, lubricating or making
repairs to any vehicle except those of a minor nature and then only
in cases of emergency.
(23)
No person shall be permitted to smoke or carry a lighted cigar,
cigarette, pipe or other lighted smoking device within, on or throughout
all properties owned, managed, maintained and regulated by the Township
for park purposes with the exception of specifically designated smoking
areas marked with signs stating "smoking permitted."

C.
The following traffic regulations shall be in force
and effect in all Township parks:
(1)
The Pennsylvania Vehicle Code Act of 1976, P.L. 162,
No. 81, as amended, 75 Pa.C.S.A. § 101 et seq., is hereby
declared to be in effect in all Township parks and on all streets
and roadways therein, with like effect as though set forth herein
in full, and the traffic rules and regulations set forth herein are
in addition to and supplement the Vehicle Code.
(2)
A rate of speed exceeding 15 miles per hour is prohibited.
Operating a vehicle in a reckless or negligent manner or in excess
of the posted speed limit is prohibited.
(3)
All persons shall at all times heed and comply with
directions of Township police officers or other persons authorized
by the Park and Recreation Board and/or Township Supervisors, indicated
by gesture or otherwise, and shall further comply with directions
on traffic signs. Directions on such traffic signs may be disregarded
only on an order of a police officer.
(4)
No driver shall stop on the improved or paved roadway
of the park for the purpose of removing or replacing a tire. No person
shall remove or replace a tire unless the vehicle is completely off
the improved or paved roadways.
(5)
Motorcycles are not to be operated on any other area
of the park except on established roads and streets in said park for
the purpose of ingress, egress and regress from a public street into
the park area, and on a parking area for parking only in any area
provided and designated as a parking area.
(6)
No automobile shall be left in any park after closing
hours without special permission from the appropriate Township officials;
the Township shall be under no obligation to reopen the park or any
parking lot, road or gate locked after closing hours in order to allow
said vehicle to be removed during a period of time when the park is
closed. Leaving said vehicle in said park after closing hours without
permission aforementioned shall be a violation of this chapter.
(7)
No person shall operate, stop or park any vehicle,
bicycle or other means of conveyance except in areas where permitted
or designated by proper authority of the Board of Supervisors and/or
Park and Recreation Board, nor operate the same in a reckless or negligent
manner or in excess of any posted speed limit or in such a manner
as to become a nuisance to other area users.
There may be a fee charged, as established from
time to time by resolution of the Board of Supervisors, for rental
and use of park facilities. Said rental fee schedule may also require
the posting of a security deposit to guarantee that park facilities
are left in good and orderly condition.
Park and recreation areas and facilities which
become hazardous for public use due to weather, water, fire or unforeseeable
conditions may be closed upon recommendation of the Park and Recreation
Board and/or Chief of Police at the discretion of the Board of Supervisors.
The police officers of the Township are charged
with enforcement of the provisions of this chapter and the provisions
of the Pennsylvania Crimes Code[1] in all parks within the Township.

The provisions of this chapter shall be enforced
by an action brought before a District Justice in the same manner
provided for the enforcement of summary offenses under the Pennsylvania
Rules of Criminal Procedure. Any person guilty of violating the provisions
of this chapter, upon conviction in the proceedings before the District
Justice, shall be sentenced to pay a fine not exceeding $1,000 for
each violation.
