Editor's Note: This ordinance provided for the termination and invalidation of the former Building, Electrical, Fire Prevention, Mechanical and Plumbing Codes (Chs. 67, 96, 106, 130 and 147, respectively). These codes were adopted 11-14-1995 by Ord. No. 95-12 and subsequently replaced by ordinances adopted 7-18-2002 (Ord. Nos. 2002-10, 2002-08, 2002-06, 2002-07 and 2002-09, respectively).
The Township hereby elects to administer and enforce the provisions of the Code Act, Act 45 of 1999, 35 P.S. § 7210.101-7210.1103, as amended from time to time and its regulations.
The Construction Code, as amended from time to time, is hereby adopted and incorporated herein by reference as the "Township Construction Code."
Administration and enforcement of the Township Construction Code shall be undertaken in any of the following ways as determined by the Council of the Township from time to time by resolution:
A. 
By the designation of any employee of the Township to serve as the municipal code official to act on behalf of the Township;
B. 
By the retention of one or more Construction Code Officials or third-party agencies to act on behalf of the Township;
C. 
By agreement with one or more other municipalities for the joint administration and enforcement of the Code Act on behalf of the Township;
D. 
By entering into a contract with another municipality for the administration and enforcement of the Code Act on behalf of the Township;
E. 
By entering into an agreement with the Pennsylvania Department of Labor and Industry for plan review, inspections and enforcement of structures other than one-family or two-family dwelling units and utility and miscellaneous use structures.
A Board shall be established by resolution of the Council of the Township in conformity with the requirements of the relevant provisions of the Code Act, as amended from time to time, and for the purposes set forth therein. At any time enforcement and administration is undertaken jointly with one or more other municipalities, said Board of Appeals shall be established by joint action of the participating municipalities.
All Township chapters or portions of Township chapters which were adopted by the Township on or before July 1, 1999, and which equal or exceed the requirements of the Code Act shall continue in full force and effect until such time as such provisions fail to equal or exceed the minimum requirements of the Code Act, as amended from time to time. Specifically, the following Township chapter enhancements shall be retained in the Township Construction Code unless excluded by or contrary to the requirements or provisions of the Code Act:
A.

B. 
Automatic sprinkler systems.
(1) 
An automatic sprinkler system shall be provided throughout a fire area containing a Group A-1 occupancy where one of the following conditions exists:
(a) 
The fire area exceeds 8,000 square feet.
(b) 
The fire area has an occupant load of 300 or more.
(c) 
The fire area is located on a floor other than the level of discharge.
(d) 
The fire area contains a multitheater complex.
(2) 
An automatic sprinkler system shall be provided throughout a fire area containing a Group A-3 occupancy where one of the following conditions exists:
(a) 
The fire area exceeds 8,000 square feet.
(b) 
The fire area has an occupant load of 300 or more.
(c) 
The fire area is located on a floor other than the level of exit discharge.
Exception: Areas used exclusively as participant sports areas where the main floor area is located at the same level as the level of exit discharge of the main entrance and exit.
(3) 
An automatic sprinkler system shall be provided throughout all buildings where the fire area containing a Group F-1 occupancy exceeds 8,000 square feet, or more than three stories in height, or where the combined fire area on all floors, including mezzanines, exceeds 24,000 square feet.
(4) 
An automatic sprinkler system shall be provided throughout all buildings where the fire area containing a Group M occupancy exceeds 8,000 square feet, or where more than three stories in height, or where the combined area on all floors, including mezzanines, exceeds 24,000 square feet.
(5) 
An automatic sprinkler system shall be provided throughout buildings with a Group R-1 fire area.
Exception: A residential sprinkler system installed in accordance with Section 903.3.1.2 shall be allowed in buildings, or portions thereof, of Group R-1.
Permitted forms, as amended from time to time, are hereby adopted and incorporated in the Township Construction Code.
All Township chapters or portions of Township chapters which are in effect as of the effective date of this chapter and whose requirements are less than the minimum requirements of the Code Act are hereby amended to conform with the comparable provisions of the new Township Construction Code.
All relevant ordinances, regulations and policies of the Township not governed by the Code Act shall remain in full force and effect. Specifically, the exclusions to permit exemption are as follows:
A. 
UCC Section 403.42(c)(1)(i) shall be deleted completely.
B. 
UCC Section 403.42(c)(1)(v) shall be deleted completely.
C. 
UCC Section 403.62(c)(1)(i) shall be deleted completely.
D. 
UCC Section 403.62(c)(1)(iv) shall be deleted completely.
E. 
UCC Section 403.62(c)(1)(xiii) shall be deleted completely.
F. 
UCC Section 403.62(c)(1)(xvii) shall be deleted completely.
G. 
UCC Section 403.62(c)(6)(iv) shall be deleted as to "…and replacement…" only.
Fees assessable by the Township for the administration and enforcement undertaken pursuant to this chapter and the Code act shall be established by the Township Council.
