The practice of hunting for, shooting at or pursuing any wild bird or
wild animal within the limits of Lower Salford during any small game season
established by the Pennsylvania Game Commission is hereby declared unlawful
and prohibited except as hereinafter provided for.
The provisions of §
102-1 hereinabove shall not apply:
A. To a property owner engaged in such activity upon his
own property.
B. When the person engaged in such activity has in his possession
the current written consent of the owner of the property upon which he is
so engaged. Such written consent shall specify the period during which it
is valid, but such period shall not exceed one year from the date of its grant.
C. To the hunting or chasing of raccoon from sunset to sunrise.
D. To the trapping of predators or fur-bearing animals.
E. To such activity when carried out upon lands participating
in the Cooperative Farm Game Program by agreement with the Game Commission
of the Commonwealth of Pennsylvania.

Any person or persons violating any of the provisions of this chapter
shall be subject to a criminal fine not to exceed $1,000 per violation and
imprisonment in the Montgomery County Correctional Facility to the extent
allowed by law for the punishment of summary offenses. Enforcement of any
such violations shall be by action brought before a District Justice in the
same manner provided for the enforcement of summary offenses under the Pennsylvania
Rules of Criminal Procedure.
