As used in this article, the following terms shall have the meanings indicated:
LEAVES
Those materials naturally formed from trees and bushes that are suitable for composting and/or mulching purposes.
PERSONS
All residential, commercial and institutional property owners and/or occupants within the Borough of Dumont.
SOLID WASTE
Includes all solid waste, garbage, leaves, refuse, trash, etc., usually disposed of under the municipal garbage contract and normally placed for curbside pickup at regular intervals by the contractor.

For the entire year, in each and every year, it shall be mandatory for all persons, except those physically disabled, who accumulate leaves, to separate all leaves from municipal solid waste and to place them at curbside for collection in accordance with the rules and regulations promulgated in accordance herewith.

The Superintendent of the Department of Public Works is authorized to adopt rules and regulations for the curbside collection of leaves. The rules and regulations shall include but not be limited to the designation of scheduled times and locations for the collection of the leaves and any rule or regulation reasonably intended to carry out the purposes of this article.
A. 
No leaves shall be placed at curbside for inclusion in the regular curbside collection of solid waste.
B. 
The use of plastic bags and plastic containers in conjunction with leaf collection pursuant to this article is prohibited.
Any person may choose to compost and/or mulch their leaves on site for their personal horticultural benefit, provided that such activity does not violate any health or safety code and is in accordance with any rules and regulations adopted pursuant hereto.
This article shall be enforced by the Superintendent of Public Works, the Board of Health, the Police Department and any other employee or department of the Borough of Dumont as designated by the Mayor and Council.
Any person who violates any provision of this article or the rules and regulations adopted pursuant hereto shall, upon conviction, be fined in an amount not to exceed $50, with each violation constituting a distinct and separate offense.
