[HISTORY: Adopted by the Common Council of the City of Lockport 12-1-1976 as L.L. No. 3-1976. Amendments noted where applicable.]
As authorized by the provisions of the Municipal Home Rule Law, § 20, Subdivision 10, of the General City Law is hereby amended by adding the provisions of this chapter hereinafter set forth.
The Common Council of the City of Lockport does hereby delegate its authority and power to award a cable television franchise under the applicable provisions of the Executive Law and regulations of the New York State Commission on Cable Television to a body hereby created and denominated the "Lockport Community Cable Commission."
The Lockport Community Cable Commission hereby created jointly by the local governing bodies of the City and Town of Lockport shall hereafter exercise all the authority and powers of such governing bodies with respect to the awarding and regulation of a cable television franchise for such municipalities. Such authority and powers shall include, but not necessarily be limited to, all the substantive and procedural requirements heretofore and hereafter promulgated by the New York State Commission on Cable Television.
Such Lockport Community Cable Commission shall consist of seven members, three of whom shall be appointed for staggered terms of one or three years by the Common Council of the City of Lockport, three of whom shall be appointed for like terms by the Town Board of the Town of Lockport and the seventh of which shall be designated as Chairman and shall be selected by the chief executive officer of each municipality. Such Chairmanship shall be for a term of three years. Two of said members shall consist of a member from the Town Board and a member of the Common Council, who shall serve during their respective terms in office. In the event that the chief executive officers cannot agree within 30 days of the commencement or expiration of the term of Chairman, the remaining six members shall select such Chairman, subject to the confirmation and consent of each governing body.
This chapter shall take effect on adoption, subject to the enactment of a substantially similar local law by the Town Board of the Town of Lockport, New York.[1]
