A certain document, three copies of which are
on file in the office of Butler Township Manager, being marked and
designated as "The 1996 BOCA National Building Code" as published
by the Building Officials and Code Administrators International Inc.,
is hereby adopted as the Building Code of the Township of Butler in
the State of Pennsylvania; for the control of buildings and structures
as herein provided; and each and all of regulations, provisions, penalties,
conditions and terms of the BOCA National Building Code are hereby
referred to, adopted and made a part hereof as if fully set out in
this chapter.
The following sections of said code are revised
as follows:
A.
Section 101.1 (page 1, second line): Insert: "Butler
Township."
B.
Section 112.3.1 (page 5): Insert: "Permit fees: The fee shall be as set forth on the schedule of fees available for public inspection in the office of the Township Manager. Such fees shall not be in addition to those required by Chapter 300, Zoning, of the Code of the Township of Butler."

Any person who shall violate any of the provisions
of the Code or who shall fail to comply therewith, or who shall violate
or fail to comply with any order made thereunder, or who shall build
in violation of any detailed specifications or plans submitted or
approved thereunder, or who shall fail to comply with such an order
within the time fixed therein, shall securely for each and every such
violation and noncompliance, respectively be guilty of a summary offense
of this code, and, upon conviction thereof before any District Justice,
shall be sentenced to pay a fine not less than $100, and not more
than $1,000 and cost of prosecution, and in default of payment of
such fines and costs, to imprisonment in the County Jail for not more
than 30 days. The imposition of any penalty for any violation shall
not escape the violation or permit the continuance thereof, and all
such persons shall be required to correct or remedy such violation
or defect within the time specified. Each day that any prohibited
act or condition is maintained shall constitute a separate offense.

The application of the above penalty shall not
be held to prevent the enforced removal of prohibited conditions nor
any other action at law or in equity.

Section 117.2 (page 6, fifth line): Insert: "$200"
and "$1,000."

Section 600.1: Change to:
Scope: In addition to the general requirements
of this code governing the location, construction and equipment of
the buildings and structures, and the fire resistance ratings, height
and area limitations of Tables 503 and 602, the provisions of this
chapter shall control all buildings and structures designed for special
uses and occupancies as herein provided.

Chemical plants, packing plants, grain elevators,
refineries, flour mills, steel mills and other similar structures
shall be constructed in accordance with the recognized practices and
requirements of the specific industry. The code official shall permit
such variations from the requirements of this code as will secure
reasonable construction with the necessary fire, life and property
safeguards. In granting such variations, due regard shall be given
to the isolation of the structure, the fire hazard and the exposure
to surrounding property.

Section 3408.2 (page 320, first line): Insert: "April
21, 1997."

The code shall be enforced by the Zoning Officer
or his authorized representative, Regulations Inspector of Butler
Township and/or such other persons as the Board of Commissioners may
designate by resolution from time to time.
Nothing in this chapter or in the Building Code
hereby adopted shall be construed to affect any suit or proceeding
impending in any court, or any rights acquitted, or liability incurred
or cause or causes of action acquired or existing, under any ordinance;
nor shall any just or legal right or remedy of any character be lost,
impaired or affected by this chapter.
