Chapter 481 of the Laws of 1991[1] authorized counties to require prisoners of County jails who require
medical or dental services to pay for such services if insured under a health
insurance policy. The Legislature of Rockland County finds it appropriate
to seek whatever reimbursement is legally available for medical and dental
care delivered to inmates of our jail.

A.Â
The County of Rockland shall be entitled to reimbursement
for costs paid by it on behalf of inmates at the Rockland County Correctional
Center for diagnoses, tests, studies or analyses for the diagnosis of a disease
or disability, and care and treatment by a hospital, as defined in Article
28 of the Public Health Law, by a physician or by a dentist from any third
party coverage or indemnification carried by an inmate.

Such third party coverage or indemnification shall first
be applied against the total cost to the hospital or other provider as established
in accordance with the provisions of § 2807 of the Public Health
Law relating to rates of payments of an individual's care and treatment,
as provided herein.
C.Â
The Sheriff of Rockland County, upon receiving a person
committed to the Rockland County Correctional Facility as an inmate, shall
determine by questioning such person, or by other procedures, if the person
carries third party coverage or indemnification for services received from
a hospital, doctor or dentist, required to be provided to an inmate by § 500-h
of the Correction Law of the State of New York.
D.Â
If the inmate has such coverage, the Sheriff of Rockland
County shall seek reimbursement for all services, medical or dental, rendered
to such inmate, as required by said Correction Law.
