The keeping of certain animals and fowl within close proximity of dwelling houses in the urban area constitutes a threat to the public health, safety and welfare of the community because of noise, noxious odors and unsanitary conditions and the possibility of the spread of disease.
As used in this article, the following terms shall have the meanings indicated:
AT LARGE
Off the premises of the owner and not under the direct control of the owner or keeper either by leash, cord, chain or otherwise.
NONDOMESTIC ANIMAL 
Any type or species of animal or fowl other than:
A. 
Dogs.
B. 
Cats.
C. 
Birds, such as canaries or parakeets, which are kept indoors.
Section 64-25 does not apply to persons engaged in commercial breeding or animal husbandry and who are otherwise subject to the performance standards contained within Section 701 of the City of Saco Zoning Ordinance nor to persons keeping nondomestic animals within that person's dwelling unit as a family pet.
No person having charge of a nondomestic animal may permit such animal to go at large in any street or public place or upon any private place or upon any private property after being notified by the owner of such private property to keep such animal off.
A. 
Any person who violates § 64-25 commits a civil violation for which a forfeiture of not less than $50 nor more than $100 may be adjudged. Each day of violation constitutes a separate violation. Each animal found in violation constitutes a separate violation.
B. 
A violation of § 64-25 is declared to be a nuisance and is subject to appropriate equitable relief, as well as the fine imposed by this section.
