An annuity or pension plan for members of the East China Township Board shall be created and established.
A. 
Plan created. The Charter Township of East China hereby creates and establishes an annuity or pension plan and program for the pensioning of its members of the Township Board.[1]

B. 
Contract authorized. For such purposes, the Charter Township of East China also hereby authorizes the Township Supervisor and the Township Clerk to contract, in the name of the Township Board, with any company authorized to transact such business within the State of Michigan for annuities or pensions.
A. 
Officers covered. The annuity or pension plans created, established and contracted for under this article shall cover each person within the following class of officers and employees:
(1) 
All members of the Township Board.
B. 
Eligibility requirements.
(1) 
Current employees. Each Township Board member who is employed on the effective date of the annuity or pension plan shall be eligible for coverage on that day, provided he or she then meets the following requirements, otherwise to be eligible on the first policy anniversary on which he or she meets them:
(a) 
He or she has completed at least zero years of continuous employment;
(b) 
His or her age (nearest birthday) is at least 21 years and not more than 75 years.
(2) 
New employees. Every employee (Board member) who becomes subsequently employed shall be eligible on the first policy anniversary on which he or she meets the following requirements:
(a) 
He or she has completed at least zero years of continuous employment.
(b) 
His or her age (nearest birthday) is at least 21 years and not more than 75 years.
C. 
Normal retirement date. An employee's normal retirement date shall be the policy anniversary of the annuity or pension plan nearest his or her birthday.
D. 
Nonparticipation.
(1) 
Prior to coverage. Any person desiring not to be so covered shall give written notice to the Township Clerk that he or she desires not to be covered, and if the notice is received before the person has become covered under the contract, he or she shall not be covered thereunder.
(2) 
After coverage. If the notice is received after the individual has become covered, his coverage under the contract shall cease as provided for in the contract.
A. 
Township portion. The Charter Township of East China shall annually contribute 100% of that portion of the premium or charges arising under such annuity or pension contract for each person within the class of officers and employees enumerated in § 36-3A hereof. Such contributions shall be secured from the general fund of the Township.
B. 
Employee portion. Each person within such class of officers and employees shall be responsible for the remainder of the premium or charges, and the Township Treasurer is hereby authorized to deduct the same from each person's pay, salary or compensation and to apply the same to such person's responsibility.
Each person so covered under the annuity or pension plan shall have a vested right or interest in such plan zero months from the date the plan becomes effective for such person.
The Charter Township of East China hereby ratifies and confirms the validity of any annuity or pension plan in existence on the effective date of this article.

The purpose of this article is:
A. 
To authorize the creation of a Township group insurance plan(s) covering life, health, hospitalization, medical and surgical service and expense, and accident insurance for certain classes of Township employees and/or their dependents and to authorize the Township Supervisor and the Township Clerk to contract, in the name of the Township, for such plan(s);
B. 
To define those classes of employees who shall be covered by such group insurance plan(s);
C. 
To set forth the maximum per centum share which the Charter Township of East China shall contribute to the premium or charges arising under such group insurance plan(s) and further provide for the deduction of contributions from employees' compensation;
D. 
To provide a method for an employee's option out of the group insurance plan(s); and
E. 
To ratify and confirm the validity of any group insurance plan(s) in existence on the effective date of this article.
Pursuant to Public Act 77 of 1989,[1] the Charter Township of East China hereby authorizes the creation and establishment of a group insurance plan or plans covering life, health, hospitalization, medical and surgical service and expense, and accident insurance for its full-time employees enumerated below, and/or their dependents, and for such purposes, authorizes the Township Supervisor and the Township Clerk to contract, in the name of the Township Board and subject to its approval, with any company authorized to transact such business within the State of Michigan for such group insurance policies.

A. 
Defined in personnel policies. Full-time employees are those members of any enumerated class who otherwise satisfy the definitions and criteria established and provided in those personnel policies adopted by the Township on May 6, 1985, and as amended.
B. 
Employee classes included in plan. A group insurance plan created, established, and contracted for under this article shall cover full-time employees within the following classes and may cover the dependents of such employees:
(1) 
Township building inspectors and their assistants;
(2) 
Township department heads;
(3) 
Township employees other than the staff of the principal Township Office who are employed for 40 hours per week on a regular basis;
(4) 
Township employees employed at the principal Township Office for 37.5 hours per week on a regular basis.
A. 
Annual Township contributions. The Charter Township of East China shall annually contribute an amount from time to time, established by a resolution of the Township Board of Trustees, of not more than 100% of the premium or charges required of such life, health, hospitalization, medical and surgical service and expense, and accident insurance contract(s) for such person within the class of persons enumerated in § 36-9.
B. 
Secured from the general fund. The Township's contribution shall be secured from the general fund of the Township.
C. 
Employee responsible for unpaid portion. Each person within such class shall be responsible for and pay any portion of the premium or charges not paid for by the Township.
D. 
Payment authorized by payroll deduction. The Township Treasurer is hereby authorized to acquire from each plan participant their authorization to deduct the same from each person's pay, salary, or compensation and to apply those sums deducted to such person's responsibility.
A. 
Written notice to Clerk. Any person desiring not to participate in any or all of the group insurance plan(s) contracted pursuant to this article shall give written notice to the Township Clerk that he or she desires not to be insured.
B. 
Participation ceases per plan terms. Participation in any of the group plan(s) shall cease as soon after receipt of such notice as is provided by the terms of each such plan.
The Charter Township of East China hereby ratifies and confirms the validity of any life, health, hospitalization, medical and surgical service and expense, and accident insurance, or any one or more of such forms of insurance in existence on the effective date of this article.
