Editor's Note: This ordinance repealed former Art. II, Corporation Counsel, adopted 5-16-1978 by Ord. No. 180-78, as amended. It also provided it is effective upon passage and publication and at such time the appointed full-time in-house Corporation Counsel commences his/her duties.
In accordance with the provisions of § 59.42, Wis. Stats., there is hereby established the position of Corporation Counsel in and for the County of Green Lake, Wisconsin.
The County Board shall employ the Corporation Counsel and set the salary for the position. The Corporation Counsel shall serve at the pleasure of the County Board and may be terminated by the Board at any time pursuant to Wis. Stats. § 59.42(1)(a).
The Corporation Counsel shall perform the duties described in the position description for the Corporation Counsel and all such other duties as the County Board or its designees may assign from time to time.
The County Board recognizes that there may be situations when Corporation Counsel may have a conflict of interest with respect to matters assigned, when Corporation Counsel may not have the skill, experience or resources required to handle a matter or where the County Board finds that legal services in lieu of or in addition to those available from the Corporation Counsel may be required or advisable in order to address the County's legal needs. To eliminate any potential for a conflict of interest or to meet the County's need for legal services, the County Board and/or its designees may retain outside counsel to work on legal matters on behalf of the County. The Administrative Committee shall maintain a nonexclusive list of qualified outside counsel that are agreeable to act in such capacity.
The office of the Corporation Counsel shall be located within the Green Lake County Government Center.
The County may, when authorized by the County Board, appoint one or more Assistant Corporation Counsels to aid the Corporation Counsel in the performance of the duties of Corporation Counsel.
This article shall be interpreted consistent with Wis. Stats. § 59.42 and nothing herein shall be construed as granting rights or privileges to the Corporation Counsel beyond those provided by that statute.
This article shall become effective upon passage by the Green Lake County Board of Supervisors and publication as provided by law and at such time the appointed full-time in-house Corporation Counsel commences his/her duties. This article repeals previous Green Lake County Ordinance No. 180-78 in total and all ordinances, resolutions, parts of ordinances or acts of the Green Lake County Board of Supervisors which are in conflict with any provision of this article.
