GENERAL REFERENCES

The regular meeting of the Common Council shall be on the first and third Tuesday of each month at 7:00 p.m. Special meetings may be held as provided by law.
The Mayor or, in his absence, the President of the Council shall open the session at the time fixed for each meeting by taking the Chair and calling the meeting to order.

Before proceeding to business, the roll of the members shall be called by the Clerk, and the names of those present shall be entered in the journal. Two-thirds of all of the members elected must be present to constitute a quorum for the transaction of business. The Mayor shall not be counted for purposes of determining a quorum pursuant to §§ 62.11(3)(b) and 64.29(2), Wis. Stats. (and as amended).

A. 
The Mayor shall preserve order and decide all questions, subject to an appeal of the Council; announce the business before the Council in the order in which it is to be acted upon; receive and submit in proper manner all motions and propositions presented; put to a vote all questions which are regularly moved or which necessarily arise in the course of proceedings and announce the result; and authenticate by his signature, when necessary, all acts, orders, and proceedings of the Council.
B. 
In addition to the aforementioned duties, the Mayor, after consulting with the City Administrator, shall be responsible for the creation, preparation and publication of the agenda for all meetings of the Common Council as well as the agenda for all meetings of any standing committees of the City.
Every ordinance shall be read twice previous to its passage, but no ordinance shall have its second reading on the same day that it is first read, unless by suspension of the rules as hereinafter provided.
All demands, claims or accounts against the City shall be verified by affidavit, and if the service shall be certified to by the officers authorizing the same, they shall be referred to and approved by the Finance Committee.
All petitions and remonstrances, when presented, shall be read at length by the member presenting the same or Clerk unless otherwise ordered.
Each member, previous to his speaking, shall arise and address the presiding officer by his proper title and shall not be interrupted except by call to order.
All resolutions and amendments shall be acted upon and then reports of all committees shall be made in writing.
The ayes and noes shall be ordered at the request of any member or the Mayor. The roll shall be called with the first member called to vote, rotating in alphabetical order on each roll call vote.
A. 
Standing committees.
(1) 
There shall be seven standing committees as follows:[1]
(a) 
Personnel.
(b) 
Finance.
(c) 
Streets, Health and Sanitation.
(d) 
Regulatory.
(e) 
Committee of the Whole.
(f) 
Public facilities.
(g) 
Ambulance.

Each such committee, except the Committee of the Whole, shall consist of three Alderpersons appointed by the Mayor. In addition, the Mayor may appoint one alternate member to each committee who shall only constitute a member should a regular member of the committee not be present. The majority of each committee shall constitute a quorum for the transaction of business.
(3) 
The Committee of the Whole shall consist of all Alderpersons. The Mayor shall preside at meetings of the Committee of the Whole but shall not be a member thereof, nor shall he vote in case of a tie. Effective May 1, 1988, the Mayor and members of the Committee of the Whole shall be compensated at a rate of $25 per meeting of the Committee of the Whole at which they are in attendance and which is not called in conjunction with a regularly scheduled Council meeting.
B. 
Duties of standing committees. The standing committees shall have such powers, duties and objectives as provided below:
(1) 
Personnel Committee. In addition to the duties assigned elsewhere, the Personnel Committee shall, on behalf of the City, under the overall control of the Common Council, be responsible for the following:
(a) 
Planning and recommending policies with respect to the safety of City employees and their working conditions.
(b) 
Directing and coordinating all matters arising under Ch. 111, Wis. Stats., and policy-making on all personnel matters involving employees of the City. In performing these duties, the Personnel Committee shall work closely with the City Attorney or labor negotiator and the City Administrator designated by the Common Council.
(c) 
The Committee shall direct the conduct of all proceedings involving the Wisconsin Employment Relations Commission, including those relative to the election, certification and decertification of collective bargaining units (including proceedings for the determination of the number of employees, type of bargaining unit and eligibility of employees in the classified service to participate in such elections) and including those relative to prohibited practice, fact finding, compulsory arbitration and mediation proceedings. The Personnel Committee shall also direct the conduct of all of the proceedings before courts or other governmental agencies involving personnel matters.
(d) 
Collective bargaining. Recognized City employee labor organizations shall submit their collective bargaining requests to the Common Council which shall refer these matters to the Personnel Committee. The Committee may then conduct a public hearing on the requests in which all interested persons may appear and state their views thereon. Collective bargaining with recognized bargaining units shall be carried on by the Personnel Committee, which shall adopt and amend rules and procedures not in conflict with any other existing ordinances or resolutions of the City governing the conduct of such bargaining. Elected officials, department heads, and supervisory personnel shall not distribute to any City employees or other person any written communication bearing upon the subject of relations matters unless communication shall have the prior approval of the City Attorney or the City labor negotiator. The agreements reached at the conclusion of such collective bargaining shall be reduced to writing by the Committee and submitted in the form of a proposed ordinance or resolution to the Common Council for its approval or rejection.
(e) 
Enforcement. The Committee shall be empowered to authorize the City Administrator to institute legal proceedings to prevent employees from engaging or continuing to engage in practices prohibited by or in violation of Ch. 111, Wis. Stats., and to enforce any ordinance or resolution by the Common Council relative to agreements reached at the conclusion of collective bargaining procedures as provided for in Subsection B(1)(d).
(f) 
Employees excluded from recognizing bargaining units. The Committee, upon recommendation of the City Administrator, will periodically, but not less than annually, review the wages, hours, and conditions of employment of all employees not represented by recognized City employee labor organizations and submit its recommendations to the Common Council. The Committee may meet with such employees, if they so request, prior to making its recommendations.
(2) 
Finance Committee. In addition to duties assigned elsewhere, the Finance Committee shall have charge, under supervision of the Common Council, of all purchases of labor, services, supplies and materials required by the City. Such purchases shall be made pursuant to the City's Purchasing Policy in its present form, and as same may be amended in the future.

All public construction shall be subject to the direction and control of the Committee of the Whole and/or the Common Council as provided in § 62.15, Wis. Stats., and as same may be amended in the future.
(d) 
Public hearing. The Finance Committee may conduct a public hearing in regard to any prospective purchase or contract, and all interested persons may appear and state their views thereon.
(e) 
Any class of public work may be done by the City or through its agencies directly without advertising for bids.
(3) 
Streets, Health and Sanitation Committee. In addition to the duties assigned elsewhere, the Streets, Health and Sanitation Committee shall be responsible for the following:
(a) 
Planning and policy setting for the repair and maintenance of City streets and sidewalks.
(b) 
Planning and policy setting for the City Water Utility and the City Wastewater Utility.

(c) 
Planning and policy setting on matters pertaining to health and sanitation, including but not limited to refuse collection and disposal.
(d) 
Planning and policy setting on matters pertaining to Chapters 120, 154, 197, 213 and 235 of this Code.
(4) 
Regulatory Committee. In addition to the duties assigned elsewhere, the Regulatory Committee shall be responsible for the following:
(a) 
Recommendations to the Common Council with respect to license applications.
(b) 
Planning and policy setting for the abatement of nuisances.
(c) 
Planning and policy setting on matters pertaining to licenses and permits.
(d) 
Planning and policy setting on matters pertaining to orderly conduct.
(e) 
Planning and policy setting on matters pertaining to Chapter 265 of this Code.
(f) 
Signs which are deemed advisory in nature shall fall under the jurisdiction of the Regulatory Committee.
(5) 
Committee of the Whole. The Committee of the Whole shall serve as a forum for discussion. No final action on any issue may be taken by such Committee.
(6) 
Public Facilities Committee. In addition to the duties assigned elsewhere, the Public Facilities Committee shall be responsible for the following:
(a) 
Planning for maintenance, repairs and remodeling of all City-owned facilities except those facilities under the control of the Utilities Commission and the wastewater treatment plant, which is under the policy supervision of the Streets, Health and Sanitation Committee.
(b) 
Recommending repairs of City-owned facilities to be included in the following year's proposed budget.
(c) 
Determining, by inspection or otherwise, not less than annually, the need for repairs of each facility. Major repairs are to be included in the proposed five-year capital improvement plan and approved by the Common Council.
C. 
Special committees. Select or special committees may be raised by resolution designating the number of members, the objective and the duties or responsibilities. Unless otherwise provided, the members shall be appointed by the Mayor.
The rules and parliamentary practice comprised in Robert's Rules of Order shall govern the Council in all cases in which they are not inconsistent with the rules adopted by the Council.[1]

These rules shall not be amended or suspended without the concurrence of 3/4 of the members elected.
In accordance with Section 39 of Robert's Rules of Order, all acts of the Council shall require a majority vote of the Alderpersons present, unless otherwise specified.

Consent agenda. The consent agenda may include all minutes from regular and closed session meetings, Finance Committee and Regulatory Committee reports, ordinances and resolutions of a procedural nature to be determined by the Mayor and City Administrator. Any item on the consent agenda may be removed for individual consideration upon a request of the Mayor or any Alderperson prior to the consent agenda being adopted.

The Common Council shall fill aldermanic vacancies by election of a qualified elector residing within the aldermanic district for which the vacancy has occurred.
