These regulations are adopted under the authority
granted by §§ 61.35, 61.351, 61.354, 62.23(7), and
87.30, Wis. Stats. Therefore, the Village Board of the Village of
Saukville, Wisconsin does ordain as follows.
The purpose of this chapter is to promote the
public health, safety, morals, prosperity, convenience, aesthetics,
and general welfare of the Village and its environs.
A.
It is the general intent of this chapter to regulate
the use of all structures, lands, and waters, regulate lot coverage,
population distribution, and density, and regulate and restrict the
size and location of all structures so as to:
(1)
Lessen congestion in and promote the safety and efficiency
of the streets and highways;
(2)
Provide adequate light, air, privacy and convenience
of access to property;
(3)
Provide sanitation and drainage;
(4)
Prevent overcrowding;
(5)
Avoid undue population concentration;
(6)
Facilitate the adequate provision of public facilities
and utilities;
(7)
Facilitate the use of innovative development techniques;
(8)
Conserve and enhance the taxable value of land and
buildings;
(9)
Establish districts of such number, shape and area
as may be deemed best suited to carry out the purposes of this chapter;
(10)
Further the appropriate use of land and conservation
of natural resources;
(11)
Preserve and promote the beauty of the community;
and
(12)
Implement the Village's Comprehensive Plan or Plan
components.

In addition, the floodland zoning regulations set
forth in this chapter have been adopted to:

To this end, it is further intended to provide for
the administration and enforcement of this chapter and to provide
penalties for its violation.
It is not intended by this chapter to repeal,
abrogate, annul, impair, or interfere with any existing easements,
covenants, deed restrictions, agreements, ordinances, rules, regulations,
or permits previously adopted or issued pursuant to law. However,
wherever this chapter imposes greater restrictions, the provisions
of this chapter shall govern.
In their interpretation and application, the
provisions of this chapter shall be held to be minimum requirements
and shall be liberally construed in favor of the Village and shall
not be deemed a limitation or repeal of any other power granted by
the Wisconsin Statutes.
If any section, clause, provision, or portion
of this chapter is adjudged unconstitutional or invalid by a court
of competent jurisdiction, the remainder of this chapter shall not
be affected thereby. If any application of this chapter to a particular
structure, land or water is adjudged unconstitutional or invalid by
a court of competent jurisdiction, such judgment shall not be applicable
to any other structure, land or water not specifically included in
said judgment.
The degree of flood protection provided by this
chapter is considered reasonable for regulatory purposes and is based
on engineering experience and scientific methods of study. On rare
occasions, larger floods may occur or the flood height may be increased
by man-made or natural causes such as ice jams or bridge openings
restricted by debris. Therefore, this chapter does not imply that
areas outside of the delineated floodplain or land uses permitted
within the floodplain will be totally free from flooding and the associated
flood damages, nor shall this chapter create a liability on the part
of, or a cause of action against, the Village of Saukville or any
office or employee thereof for any flood damages that may result from
reliance on this chapter.
All other ordinances or parts of ordinances
of the Village inconsistent or conflicting with this chapter, to the
extent of the inconsistency only, are hereby repealed.
This chapter shall be known as, referred to
or cited as the "Zoning Ordinance, Village of Saukville, Ozaukee County
Wisconsin," and is herein referred to as "this chapter."
