The purpose of this chapter shall be to protect the parks and parkways and appurtenances thereto in the village from fire, abuse and desecration; to provide for the recreational use of these areas; to control and regulate traffic and maintain general order therein; and to further the safety, health, comfort, morals and welfare of all persons while within the limits of the parks and parkways.
As used in this chapter, the following terms shall have the meanings indicated:
COMMITTEE
The Buildings, Parks and Recreation Committee.
PARK; PARKWAY
Includes the grounds, buildings thereon, water therein and any other property which is now or may hereafter be under the control or jurisdiction of the Village Buildings, Parks and Recreation Committee.
PERSON
Includes any individual, firm, partnership, corporation and association of persons, and the singular number shall include the plural.
A. 
Presence prohibited when closed. All public parks and public playgrounds in the Village shall be closed from 10:00 p.m. to 6:00 a.m. No person shall be within the Village parks between these hours.

(1) 
Exception:
(a) 
Mueller Park Boat Landing shall be closed from 10:00 p.m. to 4:00 a.m.
B. 
Exemption. The Village Board may grant permission to any group wishing to use a specific public park or public playground to use such park or public playground during closed hours beyond 10:00 p.m. Permission shall be given, in writing, and shall contain the name of the group, the name of a responsible person in charge of the group and the date for which permission to use the specific public park or public playground beyond the closed hours is granted. The Village Recreation Director may extend closing hours for all parks for Park Department sponsored activities.
In case of an emergency, or when in the judgment of the Village Board the public interest demands it, any portion of the parks or parkways or buildings therein may be closed to the public or to designated persons until permission is given to return.
No person shall interfere with or in any manner hinder any employee of the Committee nor any employee of a contractor while engaged in constructing, repairing or caring for any portion of the parks or parkways or while in the discharge of the duties conferred by this chapter.
A. 
No person shall use threatening, abusive, insulting, obscene or indecent language which constitutes a breach of the peace.
B. 
No person violating any of the prohibitions enumerated in Subsection A shall be allowed to remain in any park or parkway.
A. 
No person shall be permitted to smoke or to hold a lighted cigarette, cigar or pipe in any building or section of a building or in any park or parkway area where officially posted notices so prohibit.
B. 
No person shall throw or drop a lighted cigar or cigarette stub or empty a lighted pipe from an automobile moving along a parkway drive.
A. 
No person shall scatter, drop or leave any piece of paper, rag, tin can, peanut shells, melon rinds, banana peels or other garbage, dead flowers or other rubbish in any portion of the parks or parkways, excepting the receptacles provided for that purpose.
B. 
No person shall deposit, dump, throw or place any earth, rubbish, dust, manure, paper, garbage or other refuse matter or any sand, stone, lumber or building material or any substance in the water, grounds or roadways of any park or parkway without written permission of the Committee.
Auto radios, portable radios and television sets must be turned low at all times so as not to be heard from a distance beyond 40 feet from the instrument. No portable radio or television set shall be operated within any building unless specifically permitted in connection with a public gathering or a temporary exclusive use for which a permit has been granted.
A. 
No person shall sell, keep or offer for sale any tangible or intangible article, merchandise or thing nor solicit for any trade, occupation, business or profession or for alms within any park or parkway without the written permission of the Village Board.
B. 
No person shall distribute, post, affix or display any card, handbill, sign, placard, target, banner, flag (except of the United States) or advertisement of any kind within any park or parkway or upon any of the gates or enclosures thereof without the written permission of the Village Board. The word "distribute" shall include the scattering of printed matter from aircraft.
A. 
Special event permit required. No person or group shall sell, offer for sale or give away any intoxicating liquor or fermented malt beverages in a village park in conjunction with a picnic or other special event without first obtaining a permit therefor from the Village Board.
B. 
Issuance; conditions; fee. Such permits may be issued by the Village Board upon receipt of such information as it may require from the applicant and a permit fee as set forth in Chapter 102, Fees and Penalties. Permits shall be valid for that period of time specified by the Board.
C. 
The permit required by this section shall be in addition to and not in lieu of any permits or licenses required under Chapter 115, Intoxicating Liquor and Fermented Malt Beverages.
A. 
No person shall in any manner disturb, harass or interfere with any person or party holding a written permit as indicated previously, nor with any of their equipment or property.
B. 
Permits for the exclusive use of any picnic or play area for any specified date or time may be granted at the discretion of the Committee, and no person shall in any manner disturb or interfere with any person or party occupying the ground under such a permit, nor with any of their equipment or property.

No person shall carry, fire or discharge any gun, pistol or firearm, nor any rocket, torpedo or any other fireworks of any description, nor shall any person hunt with bow and arrow within any park or parkway. The word "gun" shall include air gun. No trapping of any kind is permitted unless authorized by the Parks Director.
No person shall throw stones or missiles in or into any park, parkway or waterways.
A. 
No person shall make or kindle a fire for any purpose except in places provided therefor, and then subject to such regulations as may be prescribed.
B. 
The use of charcoal burners in designated picnic areas shall be permitted, provided that lawns and other vegetation are not damaged, and provided further that all unburned coals or ash are disposed of in such manner as to prevent fire or damage to any park property. The person using said charcoal burners shall be responsible for providing the receptacles for the disposal of said unburned coals and ash.
C. 
No person or group shall leave a fire unattended, and all fires shall be extinguished before leaving the area.

A. 
No person shall operate a motor vehicle or any other vehicle or ride a horse in any part of the property in a village park except upon facilities provided therefor.
B. 
Animals prohibited in Village parks. Animals (except seeing-eye dogs, hearing-ear dogs or other service dogs) are not allowed in parks or parkways.

(1) 
Exceptions
(a) 
Dogs on a visible leash no longer than seven feet and under full control of the owner/handler.
(b) 
If a dog defecates in the park, the dog owner/handler must clean up after the dog and remove such excreta from the park immediately and place in proper waste receptacles.
A. 
No person shall climb any tree or pluck any flowers or fruit, wild or cultivated, or break, cut down, trample upon, remove or in any manner injure or deface, write-upon, defile or ill-use any tree, shrub, flower, flower bed, turf, fountain, ornament, statue, building, fence, apparatus, bench, table, official notice, sign, bridge, structure or other property within any park or parkway.
B. 
No person in any park or parkway shall remove any device for the protection of trees or shrubs.
No person shall ascend of land with any aircraft, including gliders and parachutes, or engage in stunt flying or parachute landing in any park or parkway without the written permission of the Committee.
No person shall sleep or camp or lodge in any park or parkway except in such places as designated for such purposes, as overnight or tourist, or trailer camps or campsites, and then only subject to the rules and regulations of the Committee governing the use of such areas. An authorized person charged with guarding such property shall be exempted from this regulation.
The location of all sewers and receivers, gas pipes, water pipes, stopcocks boxes, hydrants, lamp posts, telegraph, telephone and electric power posts and lines, manholes, conduit and pumps within any park or parkway shall be subject to the jurisdiction and control of the Committee, and their construction, erection, repair or relocation shall be undertaken only after written permission is received from the Village Board.
A. 
Regular drives and parking areas. No person shall drive any automobile, motorcycle, snowmobile or other vehicle of traffic or burden upon any part of the parks or parkways except the proper drives and parking areas, or permit the same to stand upon the drives or any part thereof so as to congest traffic or obstruct the drive.
B. 
Parking regulations. Vehicles normally shall be parked in designated parking areas. Parking along roads and drives may be controlled by appropriate signs.
A. 
Permits. All permits shall be issued by a duly authorized employee of the Village Board, in writing, and subject to park rules and regulations as fully as though the same were inserted in such permits, and any person or persons to whom such permits have been granted shall be liable for any loss, damage or injury sustained by the Village Board or by any person by reason of the negligence of the person or persons to whom such permits have been granted, their servants or agents.
B. 
Supplementary rules. Until otherwise directed by the Village Board, the Board may adopt additional or revised rules and regulations for the proper conduct and administration of the parks and parkways in the village not inconsistent with this chapter and may perform any other acts with reference to the management of the parks and parkways as are lawful and as they may deem expedient to promote the beauty and usefulness of the parks and parkways and to increase the comfort, safety, convenience and public welfare of the citizens of the village and of visitors to the parks and parkways in their use of the same.
A. 
The use of glass beverage containers of any measures or kind whatsoever is hereby prohibited in all parks in the village.
B. 
Public warning. The Village Board is hereby instructed to post in all parks in the village public signs warning all users of the parks that the use of glass beverage containers of any nature or kind whatsoever is prohibited.
Any peace officer of the village may, without a warrant, arrest any offender whom he or she may detect in the violation of any of the provisions of this chapter and take the person so arrested forthwith before a court having competent jurisdiction, and he or she shall have, at all times, the right to enter the premises of any building, structure or enclosure in any park or parkway, including such grounds, buildings, structures or enclosures which may be leased or set aside for private or exclusive use of any individual or group of individuals, for the purpose of arresting violators hereof, and may use all necessary means to attain that end.
Any person who shall violate any provisions of this chapter or any order, rule or regulation made hereunder shall be subject to a penalty as provided in Chapter 1, General Provisions, § 1-18.

A. 
Applicability. The provisions of this section shall, so far as applicable, regulate the operation of all boats and other watercraft on all that part of the Fox River lying within the corporate boundaries of the Village.
B. 
State statutes adopted. Sections 30.50 to 30.63 and 30.64 to 30.71, Wis. Stats., inclusive, are hereby adopted by reference and made a part of this section as if fully set forth in this subsection. Any act required to be performed or prohibited by such statutes incorporated in this subsection by reference are required or prohibited by this section.
C. 
Littering waters. No person shall deposit, place or throw from any boat, raft, pier, bridge, platform or similar structure, any cans, paper, bottles, debris, refuse, garbage, solid or liquid waste into the water of the Fox River.
D. 
Boat dockage
(1) 
Facilities for public use. The Village's dock facility at the Mueller Park/Boat Landing shall be provided to the public at no charge. The Village shall not accept reservation for any dock space, nor shall any persons be given priority in the use of boat docking space. Any person leaving any dockage area within the park with their boat or other watercraft shall not attempt to block or otherwise reserve any docking space therein for future use.
(2) 
Docking limits. No person shall use any facilities within Mueller Park/Boat Landing for purposes of docking or securing any boat or other watercraft for more than a total of three hours in the aggregate in any day during the hours in which the park is open to the public. Nothing contained in this subsection shall be construed as permitting the docking or securing of any boat or other watercraft during the hours of 10:00 p.m. each day to 4:00 a.m. the succeeding day, as expressly prohibited by § 135-3A(1)(a).
(3) 
Waiver. The Village Board may waive the provisions of Subsection (D)(1) and (2) on a temporary and limited basis, to authorize boat dockage under certain circumstances as may be delineated by written policy of such Board.
E. 
Permit required. No person or owner of a motor vehicle as defined by § 340.016, Wis. Stats., shall use a public boat landing in the Village unless such person has obtained and displays a valid daily or annual boat ramp user permit as provided in this Subsection E.
(1) 
Annual permit purchase. Annual permits may be purchased at the office of the Village Clerk-Treasurer in the Village Hall or through the Brown County Parks Department. Such permits shall be valid from date of purchase until December 31 of the year of purchase.
(2) 
Daily permit purchase. Daily permits may be purchased at the launch sites using the form and collection box located at the sites. A daily permit shall only be valid at the launch site where the permit was purchased for the date of the purchase.
(3) 
Fee for permit. The fee for the permit shall be established by resolution.
(4) 
Receipt to constitute payment. Receipt for payment of either a daily or annual permit shall constitute the permit for purposes of this section. The annual receipt shall be displayed prominently on the lower left-hand front windshield of the motor vehicle used for launching from the respective boat ramps or permanently affixed to the backside of the trailer winch post. The daily receipt shall be displayed prominently on the lower left-hand from windshield of the motor vehicle used for launching from the respective boat ramps. All permits shall remain on display for the entire time the motor vehicle is on the premises of the boat ramp.
(5) 
Use of daily permit. Upon purchase of a daily permit, the date of the purchase shall be clearly marked on the appropriate portion of the receipt to be used as a permit. Failure to clearly and legibly enter such date or any attempt to alter the date or use the permit on a date other than that properly entered on the permit shall constitute a violation of this section.
(6) 
County-wide permit system. Current and valid annual permits issued through the authority of the county shall be treated as Village permits for purposes of this section.
(7) 
Parking at launch sites. It shall be unlawful for the registered owner of any motor vehicle to suffer or permit the parking of a motor vehicle, which was used to launch a boat under this section, in the vicinity of the boat ramp without first obtaining and posting a permit in compliance with this section. For purposes of this section, any motor vehicle which has a boat trailer or any boat-carrying device attached thereto and which vehicle is parked in the vicinity of the boat ramp shall be presumed to have launched a boat under this section.
(8) 
Exceptions. The permit and parking requirement of this section shall not apply to federal, state, or local officers, employees or agents who are engaged in the performance of their official duties, which duties require the launch of a boat at a Village boat ramp.
F. 
Use of boat landing. No person shall use a public boat landing in the Village for a period in excess of 10 minutes. The Village Board and the members of the Police Department shall direct and control the use of the boat landings, and all persons using the same shall obey the orders of the officials. No person shall stop, park or let standing any vehicle, or operate a boat in the Fox River, so as to interfere with the ingress and egress of boats into or out of the Fox River to and from public boat landings.
G. 
Mueller Park boat launch and docking hours. The Mueller Park boat launch shall be open between the hours of 4:00 a.m. through 10:00 p.m.. After 10:00 p.m., boats may be retrieved but not launched from the facility. Overnight docking at the Mueller Park boat launch is prohibited.

A. 
Purpose. The Village operates and maintains boat landing and docking facilities as a public service. The boating activity within the areas of such facilities is substantial, and the public safety and welfare requires that the use of the property be regulated in such a manner that accidents between persons using boats in the area and persons desiring to enter the water for swimming purposes may be prevented. Because the primary intended purpose of the boat docking and ramp facilities is related to the landing and docking of boats, the regulations of this section are enacted to avoid the inherently dangerous situation created by mixed recreational use of the facilities.
B. 
Swimming and wading. Except to the extent necessary for the safe and proper launching or landing of a boat or other water vehicle, no persons shall enter or remain in the Fox River from the shoreline within 100 feet of any public boat ramp or docking facility owned or operated by the Village or from any such dock or boat ramp facility for the purpose of swimming or wading. This section in intended to prohibit recreational swimming and other recreational activities not directly associated with the launch or a watercraft.
C. 
No vehicles on docks. No person shall operate, use or otherwise be present upon any motorcycle, bicycle, unicycle or other toy vehicle including, without limitation by enumeration, skateboards, roller skis and roller skates on any public dock or boat ramp owned or operated by the Village.
D. 
Water skiing. Section 30.69(3), Wis. Stats., is adopted in this subsection by reference. No boat towing persons engaged in water skiing, aquaplaning or other similar activities shall engage in such activity within 100 feet of a public boat landing or dock without a permit.
E. 
Park department to post signs. The Park department shall erect and maintain appropriate signs upon such property advising the public of the regulations of this section.

The Director of Parks and Recreation shall permit the use of parks for recreational activities according to the rules and regulations of the Board. The Director of Parks and Recreation may lease or permit to be used the public parks for private or public groups restricting the use of the park or portions of the park to the group.

It shall be the duty of the Police Department and its officers to enforce this chapter and the park rules and regulations of the Board. No person shall resist or in any way interfere with any Police Officer, Director or park employee or their subordinates in the discharge of his or her duty or hinder or prevent any of them from discharging his or her duty in any park or on the waters of the Fox River. It shall also be the duty of all persons in the park or on the waters of the Fox River when called upon by any of the such officials to promptly heed and assist such officer in the discharge of his or her duty. Any person failing to aid in the assistance of such official when called upon to do so shall be in violation of this section.

No person shall molest, disturb, chase, or throw objects at any animal or bird within the park.

The Parks Director may issue permits to groups and organization to use specific parks, facilities or buildings for a particular event. The Parks and Recreation Committee shall establish such rules and regulations as it deems necessary for the issuance of such permits and may charge a fee or require a deposit to insure the premises are left in good order.

No person shall operate a metal detector in any park without a written permit from the Park Director.
