No City officer, contractor or other person within the City shall make any excavations or dig any hole, drain or ditch in any highway or thoroughfare without providing during the night a temporary fence or suitable obstruction around the same. Every person violating this section shall, on conviction, be fined in any sum not more than seven hundred fifty dollars for each offense.
When excavations are made in any City street, the street must be opened and the paving and the earth deposited in a manner that will occasion the least inconvenience to the public and provide for the passage of water along the gutters. Suitable barricades must be erected around the excavation and two red lights maintained at night, one at each end of the excavation. Any person violating this section shall be deemed guilty of a misdemeanor and, on conviction, shall be fined in any sum not more than seven hundred fifty dollars for each offense.

A. 
Any person who shall dig any hole, drain or ditch in any street or alley within the City, without first having obtained written permission from the general superintendent of maintenance, shall be deemed guilty of a misdemeanor and, on conviction thereof, shall be fined in a sum not more than seven hundred fifty dollars for each offense.
B. 
Any person who shall, without having first obtained permission from the general superintendent of maintenance, dig, remove or carry away any stone, earth, sand or gravel from any street, alley or public ground, within the corporate limits, or cause the same to be done, shall be deemed guilty of a misdemeanor and, on conviction thereof, shall be fined in a sum not more than seven hundred fifty dollars for each offense. Every load or parcel so removed shall be deemed a separate offense.
Any person who shall tear up or injure any pavement or sidewalk within the corporate limits, without authority derived from the mayor or City council in writing, shall be deemed guilty of a misdemeanor and, on conviction thereof, shall be fined in any sum not more than seven hundred fifty dollars for each offense.

No person shall make any excavation or dig any hole, drain or ditch in any street, sidewalk or thoroughfare within the City, without first posting a bond in the amount of the estimated cost of repairs to the street, sidewalk or thoroughfare as determined by the City engineer. The bond shall be of a form to be approved by the City attorney and City council. Each bond shall be filed with the City clerk and shall be conditioned upon the completion of all necessary repairs to the street, sidewalk or thoroughfare.
