Parades — See Ch. 129.
The Mayor and Council have determined that a number of special events conducted in the Town of Federalsburg are conducted for the general benefit of the public and some are conducted for the development of income by nonprofit charitable organizations. It is further determined that it is in the best interest of the public welfare and the orderly operation of such events to require certain permits in order to proceed. In furtherance of these determinations the following requirements and prohibitions with respect to such events are established.

Any person desiring to operate or conduct a special event must have a permit and must apply to the Clerk-Treasurer for a permit to conduct same. All applications shall specify the nature of the function or activity; the location thereof; the duration; the owner, if any; the sponsor, if any; and the next destination, if any. All applications must be approved by the Town Council before a permit permitting the function or activity may be granted. No person shall engage in any of the special event activities without a permit. No permit shall authorize any person, except the person or firm named therein, to perform the function or activity sought to be carried on, and such permit is nontransferable.

For each permit issued, the Clerk-Treasurer will charge an issuing fee of $10. The Mayor and Council reserve the right to waive this fee for certain approved civic organizations.
No person shall engage in any of the following functions or activities without a permit properly issued by the Clerk-Treasurer for which permit shall be paid the sum as stated above in § 189-3 unless that fee has been waived by the Mayor and Council for:
A. 
Special events, including but not limited to:
(1) 
All ball games in the Town of Federalsburg.
(2) 
Anything Goes Day Celebration.
(3) 
Loyalty Day.
(4) 
Fourth of July.
(5) 
Federalsburg Fireman's Parade.
(6) 
Homecoming Parade.
(7) 
Halloween Parade.
(8) 
Christmas Parade.
(9) 
Canoe Races.
(10) 
Federalsburg Fireman's Carnival.
(11) 
Ole Tyme Federalist Party Party.
B. 
Any street parade, carnival or circus, or amusement or concession event and any other event which shall be, at the discretion of the Mayor and Council, designated by the Mayor and Council as a "special event" by resolution of the Mayor and Council.

No person shall sell food or food-related products during a special event or solicit orders for retail food and food-related products within the limits of the Town of Federalsburg during a designated special event except as follows:
A. 
Nonprofit, charitable, civic groups, fraternal, or religious organizations which shall be allowed to sell food and related products on approval of the Mayor and Council.
B. 
All fixed locations already there, licensed food and related products businesses which have prior licensing from the Department of Health and which have operated at a fixed geographic location for a period of more than one month without transfer or change as to said location.
Any person or firm engaging in any of the above enumerated functions or activities without a proper permit, including the sale of food, during a special event without qualification as an exception, shall be punished for a municipal infraction as provided in Chapter 1, Article I.
