The Township Committee finds that in order to promote the general
welfare of the public and to preserve the farming heritage of Franklin
Township there is hereby established an Agricultural Advisory Committee.
A.
The
AAC shall be composed of at least three, but not more than five, residents
of Franklin Township. Initial appointments to the Agricultural Advisory
Committee organized as a result of this chapter shall be for one one-year
term, two two-year terms and two three-year terms. Thereafter each
member will serve a three-year term. A majority of the members must
be actively engaged in farming and own at least a portion of the land
they farm. The farmer-members shall, to the extent possible, represent
the different scales and types of operations and different land tenure
arrangements within Franklin Township. There shall also be two alternate
spots designated Alternate 1 and Alternate 2. The alternates shall
serve a three-year term and shall vote in the absence of a full member
with Alternate 1 being the first to participate and Alternate 2 voting
in the absence of two or more full-time members.

B.
Members
shall be appointed by the Mayor with the consent of the governing
body of Franklin Township. Each member shall serve a term of three
years. Members shall select a Chairperson, who shall serve as liaison
between the AAC and the Planning Board of Franklin Township. The AAC
shall designate a Secretary to keep notes of its meetings, which shall
be submitted to the Planning Board and Township Committee and shall
be deemed to be property of the Township. The Chairperson or his/her
appointed designee shall serve as the spokesperson for the Committee
to the Planning Board and Township Committee.
C.
Members
must comply with N.J.A.C. 2:76-17A.3 and any other similar regulations
in effect now or in the future. Members of the Township AAC or a member
of his or her immediate family is prohibited from selling or applying
to sell a development easement on his or her property or from selling
or applying to sell his or her property in a fee simple title pursuant
to the Agriculture Retention and Development Act, N.J.S.A. 4:1C-11
et seq. and the Garden State Preservation Trust Act, N.J.S.A. 13:8C-1
et seq. According to such regulations "members of the immediate family"
means the member's spouse, child, parent, or sibling residing in the
same household.
D.
A
vacancy occurring other than by expiration of the term shall be filled
by the Mayor with the consent of the governing body for the unexpired
term only.
E.
Members
shall serve without compensation.
The AAC shall meet at least three times a year. In addition,
the AAC shall meet with the Planning Board at least once a year to
report on its activities and discussions and to make recommendations.
