The owner, tenant, occupant or person in charge of property adjoining an alley designated for municipal use pursuant to this chapter shall not allow, permit or maintain any brush, weeds, dead or dying trees, stumps, roots, garbage, trash, or debris on or upon an alley adjoining or traversing over the property of said owner, tenant, occupant or person in charge.
In the event that an owner, tenant, occupant or other person in charge of property adjoining an alley fails to maintain said alley in accordance with the provisions of § 48-1 of this chapter, the Carneys Point Township Chief of Police or the Carneys Point Township Superintendent of Public Works shall provide written notice to said owner, tenant, occupant or person in charge of the property. Said notice shall inform the owner, tenant, occupant or person in charge of the property as to the violation of the provisions of this chapter and direct that said violation be corrected within 10 days of the date that said notice is served. The notice required pursuant to this section shall be served either personally or by certified mail, return receipt requested.
Any owner, tenant, occupant or person in charge of property who fails or neglects to remove any brush, weeds, dead or dying trees, stumps, roots, garbage, trash or debris on or upon an alley designated for municipal purposes pursuant to this chapter within 10 days after written notification to remove same shall be subject to a fine not exceeding $1,000 or imprisonment in the Salem County Correctional Facility for not more than 20 days, or both.
Upon the failure of any owner, tenant, occupant or person in charge of property to remove any brush, weeds, dead or dying trees, stumps, roots, garbage, trash or debris from an alley designated for municipal use pursuant to this chapter, said items shall be removed by Carneys Point Township. The Carneys Point Township Superintendent of Public Works shall certify the cost of removal to the Carneys Point Township Committee. Upon examination of said certificate, the Carneys Point Township Committee, if it finds the certificate to be correct, shall cause the cost as shown thereon to be charged against said lands and such additional assessment shall be added to and become a part of the taxes next to be assessed and levied upon said lands, the same to bear interest at the same rate as taxes and shall be collected and enforced by the Carneys Point Township Tax Collector.
The imposition and collection of a fine or other penalty pursuant to § 48-3 hereof shall not bar the Township of Carneys Point from all of the rights and remedies permitted pursuant to § 48-4 hereof.
The alleys designated for municipal use pursuant to this chapter are those at the rear of properties fronting on the following streets and roads:
