The following terms, phrases and words as used
in and for the purposes of this Article shall be deemed to have the
following meanings:
Any vehicle propelled otherwise than by muscular power, except
such vehicles as run only upon rails or tracks, found in any public
street, highway or lands and not bearing current registration plates
or, if bearing current registration plates, remaining stationary and
unused on the public street, highway or lands for more than 14 days
consecutively.
Any individual, firm or corporation being the owner or other
person having any legal right in, of or to an abandoned motor vehicle.
The Police Department of the Township of Carneys Point.
It is hereby declared and determined that the
public policy of the Township of Carneys Point is to prevent the unsightly
and unsafe conditions upon the public streets, highways and other
public lands that result from abandonment of motor vehicles thereon.
No person shall abandon a motor vehicle upon
the public streets, highways and lands in the Township of Carneys
Point.
All abandoned motor vehicles shall be taken
in possession by the Police Department and removed to a storage place
designated by the Township Committee of the Township of Carneys Point.
Upon the taking into possession of an abandoned
motor vehicle, the Police Department shall follow the procedures established
by Title 39, Chapter 10A, of the Revised Statutes of New Jersey to
sell such abandoned motor vehicles at public auction.
The Township Committee of the Township of Carneys
Point may, by resolution, designate a special agent or representative
of the Township of Carneys Point for the purpose of collecting abandoned
motor vehicles in the Township of Carneys Point, and such special
agent or representative shall post a bond in such amount as established
by the Township Committee of the Township of Carneys Point for the
faithful performance of his duties.
The Township Committee of the Township of Carneys
Point may, by resolution, grant permission to any person purchasing
abandoned motor vehicles at public auction in the Township of Carneys
Point pursuant to N.J.S.A. 39:10A-1 et seq. to store the vehicles
so purchased and to disassemble the same if desired by such purchaser
on a site located in the Township of Carneys Point, provided that
such site is approved by the Township Committee of the Township of
Carneys Point, and further provided that such purchaser shall remove
all such motor vehicles so purchased from the Township of Carneys
Point not later than 90 days from the date of the public sale at which
he purchased the same. Any person granted permission to store and
disassemble such motor vehicle under the provisions of this Article
shall post a bond with the Township of Carneys Point in such amount
as the Township Committee shall establish for the faithful performance
of his obligations hereunder and to guarantee the performance of any
special terms and conditions which the Township Committee may, by
resolution, fix.

Any person violating any provision of this Article
shall, upon conviction thereof, be subject to a fine not exceeding
$1,000 or confinement in the County jail for a term not exceeding
90 days, or both, in the discretion of the Municipal Judge, and each
day that such violation shall continue shall be deemed a separate
offense.

It shall be unlawful for any owner, possessor
or occupant of lands in the Township of Carneys Point, County of Salem,
to permit to be stored or placed upon land any machines or vehicles
so in need of repair as to render the same incapable of being readily
operated under their own power, except where such storage is specifically
authorized by the Zoning Ordinance of the Township of Carneys Point[1] or by a variance granted by the Carneys Point Board of
Adjustment. It shall also be unlawful for any owner, possessor or
occupant of lands in the Township of Carneys Point, County of Salem,
to permit to be stored or placed upon such land any automobile or
other motor vehicle which does not bear a current registration sticker
and a current inspection sticker, except that the provisions of this
sentence shall not apply to any farm use vehicle.
It shall be unlawful for any person to park
or leave standing any machines, automobiles or parts of automobiles
or vehicles so in need of repair as to render the same incapable of
being readily operated under their own power on land of another without
permission of the owner, possessor or occupant of such lands.

Upon complaint of any resident or property owner
of the Township of Carneys Point or upon his own observation of a
violation of this chapter, any member of the Police Department, the
Construction Code Official, Building Inspector, Housing Officer, Zoning
Officer or such other official as is designated by the Township Committee
shall notify the owner and possessor or occupant of said lands as
to the violation of this chapter. Said notice shall be in writing
and shall be delivered, either personally or by certified mail, return
receipt requested, to the owner and possessor or occupant of said
lands. Said notice shall advise the owner and possessor or occupant
of said lands to remedy said violation within 10 days after receipt
of said notice or to make application within said 10 days to the Carneys
Point Township Zoning Board of Adjustment for the appropriate relief.

Any of the officials named in § 200-11 of this chapter shall reinspect said lands after the ten-day period shall have expired, and, if he finds that the condition complained of and previously found to exist in violation of this Article has not been abated or remedied and, further, that no application has been made to the Carneys Point Township Board of Adjustment, he shall file a complaint in the Municipal Court against the owner, possessor and/or occupant of the lands affected for violation of this Article.

Any person violating any provision of this Article
shall, upon conviction thereof, be subject to a fine not exceeding
$1,000 or confinement in the County jail for a term not exceeding
90 days, or both, in the discretion of the Municipal Judge, and each
day that such violation continues shall be deemed a separate offense.

Where the aforedescribed personal property comes into the possession of any of the officials named in § 200-11 of this chapter by finding or recovery and if the owner or his whereabouts is unknown and cannot be ascertained or if said owner shall refuse to receive such property, then said property shall not be disposed of for six months, except in cases of a motor vehicle, which shall be retained for three months. Thereafter, the Township Committee, by resolution, may provide for the sale, in whole or in part, of any such property at public auction, after notice of a designated time and place therefor, not less than 10 days prior thereto, is published in a newspaper circulating within the municipality. Moneys received from the sale of any such property shall be paid into the general municipal treasury.
