There shall be fire companies as authorized by the Township Committee, Township of Cinnaminson. The Chiefs of the fire companies are selected from the membership of each fire company to serve for terms of one year. The fire companies shall act according to the rules and regulations for volunteer fire companies. The Township Committee, in their municipal budget, may contribute aid to the volunteer fire companies under the provisions of N.J.S.A. 40A:14-34.

A. 
Establishment.
(1) 
There shall be a Municipal Court in the Township of Cinnaminson, known as the "Municipal Court of the Township of Cinnaminson in the County of Burlington." The Municipal Court shall have, possess and use all of the functions, powers, duties and jurisdiction conferred by the provisions of N.J.S.A. 2B:12-1 et seq., as amended and supplemented, or by any other law. The Municipal Court shall have a seal which shall bear the impress of the name of the Court. The cost and fees charged against defendants, when collected, shall become municipal funds and shall be turned over to the custodian of the funds of the municipality. The fines and penalties imposed in said Municipal Court shall be deposed of as prescribed by law.
(2) 
The Municipal Court shall be held in the Cinnaminson Township Municipal Building and the Judge of the Municipal Court shall during such hours and at such times as the business of the Court may require, subject to the rules applicable to municipal courts.
B. 
Municipal Judge.
(1) 
Appointment. There shall be a Municipal Judge who shall be appointed by the Township Committee and who shall serve for a term of three years from the date of his appointment, and who shall be an attorney at law in the State of New Jersey as prescribed by law. The Judge of the Municipal Court shall receive an annual salary as prescribed in the Salary Ordinance.[1]

(2) 
Duties of the Municipal Judge. The Municipal Judge shall sit on such dates and times of each month until the calendar is completed and such other times as the business of the Court may require. The dates and times of the Court sessions shall be as established by the Court. The Municipal Judge shall exercise the functions, powers, duties and jurisdiction of the Municipal Court.
C. 
Municipal Court Administrator.
(1) 
Appointment. There shall be a Municipal Court Administrator who shall be appointed by the Township Committee, subject to civil service rules and regulations, and shall receive compensation as prescribed by the Salary Ordinance.[2]

(2) 
Duties of the Municipal Court Administrator. The Municipal Court Administrator shall:
(a) 
Carry out the rules, regulations, policies and procedures relating to the operation of the Court.
(b) 
Interview and speak to prospective complainants; receive complaints and dispense information relating to Court matters.
(c) 
Maintain the financial records of the Court.
(d) 
Attend Court, take minutes of the trials and enter them in the docket; arrange trial calendars; sign court documents, prepare and issue warrants and commitments.
(e) 
Take and prepare bail bonds, making inquiry as to their sufficiency and equity; receive and account for fines and costs.
(f) 
Interview persons on informal Police Court matters to determine if there is a basis for formal action and, if necessary, issue summonses requiring court appearances in this regard; maintain and classify records and files.
D. 
Assistant Municipal Court Administrator. The Assistant Municipal Court Administrator shall be appointed by the Township Committee, subject to civil service rules and regulations, and shall serve in the absence of the Municipal Court Administrator and shall perform all duties of the Municipal Court Administrator. The Assistant Court Administrator shall receive a salary as prescribed by the Salary Ordinance.
E. 
Violation Clerk. There shall be a Violation Clerk appointed by the Municipal Judge for a one-year term or until qualified under civil service. The duties of the Violation Clerk shall be to accept fines and bail, issue receipts for the same and follow the rules and regulations of the directives issued by the Department of Courts, State of New Jersey. The Violation Clerk shall receive a salary as prescribed by the Salary Ordinance.[3] The Violation Clerk shall be available to accept fines, etc., between the hours of 9:00 a.m. and 5:00 p.m. daily, and other hours as required.

F. 
Public Defender. There shall be the office of Township Public Defender. The Township Committee shall appoint an attorney licensed to practice law in the State of New Jersey to serve as Township Public Defender for a one-year term to expire December 31. The Township Public Defender shall represent those individuals who are qualified and apply for representation. A person applying for representation by the Township Defender shall pay an application fee not to exceed $200. The Municipal Court may waive said application fee in whole or in part if the Court determines in its discretion through a clear and convincing showing by the applicant that the application fee represents an unreasonable burden on the person seeking representation. The Municipal Court may also permit the payment of the application fee over a period of time not to exceed four months. The Municipal Court shall utilize the "Financial Questionnaire to Establish Indigency - Municipal Courts," in conjunction with the Public Defender Eligibility Guidelines established and approved by the Administrative Office of the Courts in the State of New Jersey pursuant to state law, in making this determination.

G. 
Municipal Prosecutor. There shall be a Municipal Prosecutor. The Township Committee shall appoint an attorney licensed to practice law in the State of New Jersey to serve as the Municipal Prosecutor for a one-year term to expire on December 31. The Municipal Prosecutor shall conduct prosecutions for crimes and offenses cognizable by the Municipal Court of the Township of Cinnaminson, including violations of ordinances of the Township, complaints of any departments under state law and violations of rules and regulations duly promulgated by any department, except such crime and offenses as it may be the duty of the County Prosecutor to prosecute. The Municipal Prosecutor shall receive an annual salary as prescribed in the Salary Ordinance.[4]

There shall be an Office of Emergency Management, the head of which shall be the Civil Emergency Management Coordinator. The Emergency Management Coordinator shall be appointed by the Mayor upon approval of the Township Committee for a period of three years. The Emergency Management Coordinator shall be a resident of the Township of Cinnaminson. The Emergency Management Coordinator shall have the powers, functions and duties prescribed by law. The Emergency Management Coordinator shall be compensated as established under the Township’s Salary Ordinance.[1]

The Township Committee shall be designated as the appropriate authority as provided for in N.J.S.A. 40A:14-118 and hereby designates the Township Administrator as its designee to perform all functions of the appropriate authority under N.J.S.A. 40A:14-118. The Township Committee may suspend or revoke such designation in its sole discretion at any time, with or without cause, by a duly adopted resolution.
